EMB Lending SSS Loan from my deceased Father and Mother

Such a relief to be able to find this website. Hope I can hear some advises from you for peace of mind.

My father had an SSS Pension loan is EMB Lending Corp  here in Bacolod. He died 2009 and the pension was passed to my Mother and so is the loan. My mother died 2014 and since I had to claim Funeral Claims in SSS I had to go to EMB Lending to get their ATM Card as per required by SSS. I was surprised to see that my parents put me as the co maker of their loan and they did purge my signature.

The one in charge in the account insisted that I sign a document promising to pay the amount of 45000. I was surprised to know how big the loan is when they were the one withdrawing my Father's pension since he started applying in their company. Since I am eager to get my mothers Funeral claim to pay for her funeral etc. I signed and they took a picture of me.

Being a breadwinner and a single mom..I can't cope with paying for the loan. However, years passed and I have this fear I might see myself being wanted by the police or arrested, leaving my young child behind.

I need advise. They have lost contact on me since I changed my number and had changed address..

It is a well-known principle in law that no one gets imprisoned for civil cases. Payment of a loan, if there will be a case against you, is civil in nature and will not get you imprisoned.

You may encounter problems when you will have transactions with SSS in the future, since your name might be tied up with the loan that your mother and father left behind. If that will happen, you should seek the help of a lawyer to negotiate for your behalf a payment scheme that will not financially burden you so much. Usually, the SSS representatives would agree to have a staggered payment since what they are after is fulfillment of the loan.
