Good day!
Ask lng po sana ng advise.Bumili po kami ng land last april 2016 at binayaran namin ng cash at kasi pa alis kami pa ibang bansa we asked the seller if pwede sía na mag transfer.After 6mnths umuwi kami kaso hindi pa rim na transfer yung land under my name at panay lng ng promise yung seller sa amin.April 2017 pa alis na naman kami abroad so nag decide kami na mag kota sa lawyer ko at gumawa ng MOA na himdi kami mag file ng case till end of 2017 pero dapat ma transfer na nila.Kaso till now wla pa rin at panay pa rin pangako ng seller sa amin.Ano po ba dapat gawin?

moderator

maybe it would be better to just get the documents and have someone transfer it for you. If they refuse, then there might be something wrong which the are hiding

attyLLL,thank you for the time.actually umamin yung seller na naka mortgaged yung land na yun at panay pangako nila na tutubusin nila yun from the cooperative kaso mag 2yrs nalang at tapos na yung binigay namin na time frame dun sa MOA at wla pa ring pagbabago.napag isipan namin na mag sampa ng estafa.pwede ba yun?

sadly this is partly your fault for not doing due diligence and making sure that all the issues of the property are resolved. if you knew of the mortgage or it was annotated on the title, there was no estafa because you had the opportunity to discover this if you had checked
