1. if she abandoned you for more than a year, yes.
2. if you are married, you can have shared custody. if you want sole custody, you have to battle it out in court.
3. no unless you have a court order doing so.

1. Homosexuality is a ground for legal separation.
2. If your daughter is below seven years old, you will have to prove your wife is unfit. An assertion that she is a lesbian and therefore she should be deprived of custody is both insufficient and discriminatory.
3. It's a free country and unless the photo of your daughter is being used to further some illegal trade, NO.
