last pay and COE

Good day po, tanung ko lang po sana kong makukuha ko pa ba yung last pay ko from my previuos employer kahit na 2yrs na ang nakalipas? nagClearance na po ako at yung accountant nalang ang di pa nkakasign pero pinaiwan na po ng HR umg clearance form at sabi sakin na sila na dw ang magpapapirma. One day po nagtext ung HR sakin na pede ko na dw pong kunin last pay ko ang kaso po binawasan nila ung last pay ko (unauthorized deduction) kaya di ko muna kinuha. Ngayon po gusto ko nang kunin makukuha ko pa po ba? sa pagkakaAlam ko iba na po ang HR nila. another question is, anu po ung mga grounds para di sila mag-issue ng COE?

Remember, walang right ang employer para hindi ibigay ang sahod mo and if hindi nila binigay pde ka mag-reklamo sa DOLE. Also, for unauthorized deduction you may asked for documentation bakit meron kang kaltas and if "bogus", again pde reklamo sa DOLE.

Ganto po kasi, auditor po ako at ung auditee ko ay nagkarun ng shortages na medyo malaki ang amount.. so my employer decided na ishare ako sa charge, 3k ung kinaltas sa sahod ko. di na din ako nkabalik dun sa company dahil nagstart na ako agad sa new job ko.

There is no grounds for them not to release your COE since you complied with the requirements and also you've accepted to shouldered the shortages of your colleagues. Go to your previous employer establishment and set time for them to comply with your demands which is your last remaining pay and COE and if they will not comply, present it to DOLE. And make some copy to provide documentation for them to sign it, just in case.

good day po, nagpunta na ako sa previous company pero ayaw na po nila ibigay ung lastpay at coe ko. my employer said that idadamay daw nila ako dun sa kaso ng colleague ko, connivance dw po ang ikakaso nila saken. help naman po.

Yung sinabi mo na auditee mo ay may malaking shortage, did you report this in your audit report or did the company found out another way?

Kung ikaw ang nag report, then there is no connivance since you are the one who exposed it.

Anyway, to hasten the release of your final pay, file a monetary claims in DOLE. they will invite you and your previous company representative to discuss it in front of them, which usually result in forcing the company to release the final pay, with CoE within two weeks period. and I emphasize "Usually" but not always.

i did report it sir, ang kaso po nung nag audit ung supervisor eh magkaiba po kami ng audit result. bale po mga 5 months na po akong resigned sa company bago sila nag audit ulit, then may nakita po silang mga accounts na hindi kasama dun sa audit ko kaya yun daw po yung dahilan kong bakit damay daw po ako. pero di ko po talaga napansin ung 2 account na un. siguro po nakaligtaan ko lang talaga sa dami ng ina-audit ko.

Suggest that you talk to your previous employer and convince them that you are not in connivance with the one you audited and that you made an error not finding the additional problems in those 2 accounts. What is important now is to clear your name first because if you have a bad record and you applied to other companies who do background investigation, they might state about your connivance and you might not get a job in the future.

opo sir, nag punta pa nga po ako dun sa dating company ko to clear things out nung sinabi nila saken na may mali dun sa audit ko. sinabi ko din po dun na kong may mga katanungan pa sila na pwede nila ako tawagan pero di naman na po sila nagparamdam. nung nakaraan po tumawag ako sa HR nila ngaun pero until now wala pa din po sila update.
