We're living on a private subdivision where my house seat at the corner and the road is like a blind curve. This put members of my family in danger whenever going outside the house whenever any type of vehicles passing thru. So I disallowed anyone to park on a certain portion of that road and keep it clear to mitigate this problem.
I have one neighbor but a few blocks away (not even close to my house) who insist parking their 2 tricycles on that road. In short we ended fighting, and i ended up damaging their tricycle due to my anger.
The reason I did it was she said something really bad against me. My 2 sisters were there that time and reacted right away and ended fighting against my neighbor. Out of my anger, I'd kick and damaged the motor cycle. Complains filed in our Barangay, after 2 hearings, both parties agreed, I'd made settlement more than the price of the damage I'd made. Inside that "kasunduan" i promise to her to bring her to private hospital to have her check by specialist. The next day, we did the check up and scan to her head, even she is very un-cooperative and lots of alibi and lies. Anyway, I made most my promises . After more than a week, she went to baranggay and file a complain against my wife, saying that we're not doing our promeses and agreements and wanted to re-open our case. She want to give back the money and saying she was just forced to take the settlement and signed the "Kasunduan". During that settlement, there were 5 Barangay officials. 2 of them signed on that agreement, my neighbor and her mother signed it. This is complete a lie.
May I ask, if she has the right to give back the money and re-open the case and file the case in the court. Could you please give me advice and what legal action we can do. We feel harassed at this moment and we have to many things to attend, instead of this problem.
