good afternoon. i want to seek legal advice regarding sa sitwasyon ng friend ko. may anak siya sa dati niyang live in partner. then it so happen na nahuli niyang may ibang lalaki sa loob mismo ng bahay nila and according sa kasambahay nila, madalas daw yung lalaki dun kapag wala siya. dun natutulog. and to tell you, kasal na sila ngayon nung lalaking yun. so the problem is yung sa bata. simula nung naghiwalay sila, nagbibigay ng sustento yung friend ko. though hindi ganun kalaki kasi minimum wage earner lang yung friend ko. let's say mga 3k per month. then si girl, nagdedemand. naliliitan sa binibigay. until di niya na pinapakita yung bata everytime na bibisita yung friend ko. may karapatan bang kasuhan ng economic violence yung friend ko? or may karapatan magfile ng case yung friend ko regarding visitation rights? And if proven na di sa kanya yung bata thru DNA test, ano pwede maging legal action ng friend ko? thanks

FACTS:

1) di sila kasal ng friend ko
2) nanlalaki yung girl
3) aminado si girl na di siya sure kung sa friend ko yung bata kasi umamin siya na nakipagsex siya sa iba
4) surname ng friend ko gamit nung bata
5) nagpakasal na yung girl ngayon dun sa alleged third party (proof na may relasyon nga sila nung lalaki and ground para iwan ng friend ko yung girl)
6) more than a year na di pinapakita ni girl yung bata sa friend ko
7) nagstop na magsustento yung friend ko kasi di na pinapakita sa kanya yung bata.

karapatan ng ama yung visitation rights. pwede sya magreklamo kung ipinagkakait sa kanya to.

ang support ay base sa kapasidad ng magulang at pangangailangan ng bata. kahit sino pwede magsampa ng kaso pero ang tanong eh kung pano ito tatakbo kung wala naman talaga basis yung reklamo. kung totoo na yun lang talaga ang kayang isupport ng tatay, hindi sya lumalabag sa batas.

kung mapatunayan na hindi sya ang tatay at pinaako sa kanya ang bata, pwede nya kasuhan ang babae for damages.

Okay po. thanks sa advice. another question, may certain amount ba or percentage for child support? if walang basis yung babae kung sapat ba o hindi yung ibinibigay ng friend ko, di siya pwede magfile ng case? tama ba understanding ko? tama ba na pag nagpakasal yung friend ko mas liliit yung magiging share ng illegitimate child?

as ive said, kahit sino pwede magfile ng case kahit pa allegations lang meron sya. ang korte ang maguusisa ng kaso kung may basis ba talaga sinasabi nya. pwede hingan ni friend mo ng break down ng gastusin ng bata para malaman nyo kung may basihan ba hinihingi nya.

oo mas maliit ang parte ng illegitimate child vs legit in terms of mana.

Ano lang daw ba ang inclusions when it comes to support? kasama ba ang bayad sa yaya? pati rent? kasi dati ganun. natawa nga ako nung sinabi niya yun. another thing is, what if sa mamahaling school ipinasok nung girl yung bata, need bang makipaghati ng friend ko knowing na maliit lang sinasahod niya? unless presided by the court, malalaman ba kung ano yung justifiable amount ng support? or need talagang idaan pa sa korte?

If the parties cannot agree, it is the court that determines what is fair.

Anything that is agreed upon outside the courts is a matter of concession and mutual agreement.

Follow-up question:

What if after DNA test, maprove yung paternity ng friend ko, but the girl and his husband insist na papalitan surname nung bata, is it possible na matalo yung friend ko if ilalaban niya yun sa korte? kasi nagusap sila nung lalaki na plano nila palitan apelyido nung bata under his surname since kasal na nga sila nung girl. e syempre hindi papayag yung friend ko lalo na if positive yung result ng DNA. sabi nung lalaki na sa korte nalang daw maguusap. Is it okay na papalitan nila kahit walang consent ng friend ko?

Well the husband of the biological mother could petition the court to adopt the child. Ano ba ang ipaglalaban ng kaibigan mo? The illegitimate father has NO RIGHT TO CUSTODY of the illegitimate child. He only has visitation rights.

The consent of the biological parents is usually necessary in a petition for adoption, but there are some instances wherein the father was missing, or did not want to cooperate that the court granted the petition because it was in the best interest of the child.
