I am renting a condo unit since July 1, 2016 and the contract is until June 30, 2017. The owner has my 2 months deposit right now. Last April, the owner asked me whether I will extend the rent and I told her if she changes the aircon, I will extend for 10 more months. There was no actual written contract. We contacted through text messages.
The owner changed the aircon, and now I want to move out so I told her last May 23 that I will not extend the contract anymore. The owner is saying she cannot return the deposit because she wouldn't be able to find a tenant for July so she will have some loss. What I thought is that when I told her that I will extend the contract, she would come with contract paper and sign on it, but her family went to Europe and until now, there is no written contract.
And if I cannot get the deposit, can I take the aircon since the aircon will be deducted from the deposit? Anyway the owner had to change the aircon since it wasn't working properly. I don't know why she is using my money for her property. What she said is she will deduct it from the deposit, but I cannot get the aircon out.
When we were having the first contract last year, she said she will change the wardrobe but she hasn't changed it yet, and the wardrobe is too old to use. Isn't it that they also broke the contract if the verbal contract is binding?
I am wondering if I can get back the deposit. I know not the whole deposit will be returned, the damages and left bills will be deducted from the deposit.
And in this case, how can I tell the owner to give me back the deposit?
I am still staying in the unit.
