Itatanong ko lang po kung ano magandang gawin ng Nanay ko kasi alam nyang minana nya ay 2.5 hectares lang pero nakalagay sa Tax dec sa munisipyo ay 63,205sq.m.
Paano po kaya maitatama yun? Gusto po kasi nya maibenta sna yung lupa dahil kailangan nya ng pera.

Titled na po ba yan? if yes, ano po ba ang nakalagay na land area sa titulo? If you have a copy of the survey plan and the title. Proceed to the Assessor's Office where the land is located and request for a correction of tax declaration.

Mawalang galang na po sa tanong kong ito, BUHAY pa po ba ang lola mo? If yes, pwdeng sya na lang ang pumirma sa sales documents na gagawin nyo. Kung Patay na, may mga proseso at dokumento pa po kayong kailangang gawin.

Kailangan mo ng geodetic engineer para masukat o masurvey yang lupa nyo.

At dahil patay na lola mo, hindi na sya makakapag execute o makaka pirma ng ano mang dokumento. Kaya ang kailangan mong gawin para di maghabol yung legal heirs, gawa kayo ng extrajudicial settlement of estate with waiver of rights. pa pirmahin mo silang lahat na legal na tagapag mana.

Okay po. Eh paano po yung mga apo sa USA kailangan pa ba sila g papirmahin? Mga American Citizen po sila.

If they are the legal heirs. So it is required to secure their signatures. Kung nasa America sila then they have to assign an atty-in-fact thru executing an SPA to act and sign on their behalf. and it should be consularized.
