Hi po. Nag resign po ako pero ayaw pirmahan received and approved ng employer ko kasi daw po hindi pa po daw tapos ung contract ko in which siya naman ang di sumusunod. Nakacontract po kasi ako for 3 years sa kanya signed 2014 po, around 2nd year (Aug 2016) nagtayo po sya ng bagong branch sa ibang place since wala pa po siyang permanent manpower dun pinapirma nya po ako ng contract for 2yrs para makakuha siya ng lisence, since interested po ako maassign sa place na un nag sign po ako. Pero ang nangyari po is parang naging reliever lang po ako dun kasi mostly dito parin ako sa 1st branch nya, inintindi ko na lang kasi nga d pa tapos ung contract ko na 3years. Around Jan 2017 nakahanap daw siya na permanent para dun sa bagong branch nya then ako naman will stay dito sa luma in which expired na ung contarct. Clear naman po dun sa bagong contract that I will be working on that new branch (specific naman po since magiba naman ung company name nung dalawa) then wala naman nakalagay na transferable. Since ayaw ko na I decided to resign. Binigay ko resignation letter ko ayaw tanggapin kasi daw may contract pa daw ako. Paano po kung umalis ako d nya po pinirmahan ung letter tapos ireport ako as awol ideny nya na nagbigay ako ng letter? The only proof na meron ako is ung sent items sa email ko, kasi nagsubmit din po ako thru mail, enough na po un para madefend ko sarili ko in case ireport ako as awol?
I hope maintindihan at matulungan nyu po ako. Thank you po.

P.S. in 3 years na employed ako sa kanya never siya nagbayad ng SSS ko.

1. AWOL ka parin naman, kahit na hindi nya ideny na natanggap yung sulat mo. Kung gusto mo isuggest mo nalang na abandonment ang itag sayo but its the same thing.
2. Pwede mo syang isumbong sa SSS

May right naman ako magresign di ba? Basta magbigay lang ako ng written notice 30 days before? Well maybe they can tag me whatever they want, my concern is how can I defend myself in case idemanda nila ako?

yes you can resign but that doesn't mean they cannot sue you for breach of contract. Yung location or pag transfer ay prerogative ng employer. up till when ang contract mo?

medtech po kasi ako the same time drug test analyst. Ung DOH po required na kung anong branch or name ng clinic ung nasa contract dapat dun lang ako magreport. Tapos na po ung 3 yrs contract ko dito so what remains is the 2yr contract which state na dapat dun ako sa new branch nya magreport kung itrtransfer nya ako ulit dito depat irenew ung contract in which I will refuse to sign kasi inconvenient na para sa akin. So kung pinapareport nya pa ako dito kung saan expired na ung contract I think we are violating DOH rules and regulation.
So paano po ung case na wala akong benefits like SSS, Philhealth? Paano ka pa po magsstay sa isang employer na itrtransfer ka na lng basta basta without your approval tapos wala pang SSS, walang holiday pays, and d daw sya nagbibigay ng separation fee kahit tapos na contract mo?

1. hindi po talaga nagbibigay ng separation fee unless tinatanggal ka nila.
2. Yung DOH regulations is another matter. Kahit magtransfer ka ng branch hindi ikaw ang sisitahin ng DOH kundi yung employer mo.
3. Again if kulang ang binibigay na benefits pwede kang magreklamo sa designated agency.
a) No SSS - complain at SSS
b) No Philhealth - Complain at philhealth
c) No overtime - complain ng DOLE
4. Re transfer - prerogative talaga ng employer yan. Kung kelangan ng approval mo magiging prerogative mo yun.
5. Yes i understand your reasons, again im telling you nothing prevents your employer from suing for breach of contract.

1. You are not entitled to separation pay if your contract ends unless your contract says so.
2. Lukekyle is right, this is between the DOH and your employer, and if you want to correct this, report this prohibited practice to the DOH
3. If your benefits are not being paid then file the necessary complaint with the corresponding agency responsible. There are forms to fill out.
4. Your approval is not needed for you to be transferred. The employer has the prerogative to utilize your services where it deems fit to utilize them, because that is what you are being paid for. If you do not like this kind of set up, you may put up your business.
5. Resign at your own risk. You cannot be forced to work for an employer that you cannot stand, but this does not prevent them from suing you in return.

Thank you po sa replies.
Tanong lang po, regarding po sa pagtransfer ng branch, ung work ko po is managed by information system provided by DOH ung record ko po is tagged dun sa branch na nakastate sa contract. Now, since dun po ako sa isa niyang branch pinapareport the problem is paano siya makakarelease ng result kasi wala nga roon ung biometrics ko, ung solution niya is through tampering the database, bypassing the biometrics then magiiwan na lang daw ako ng presigned papers for printing na lang para makarelease sila ng result kahit wala ako dun which is clearly illegal. I think if your employer is involving or forcing you in such violations is enough ground for termination of employment. Pls help.
