I bought an RFO condo unit 6 months ago through home loan. Bank processing went fine and the developers were fully paid within a couple of weeks. However, the turnover process didn't happen. We tried to follow up multiple times through our agent, but didn't hear any update until 3 months later in January, when they sent the contract for signing. Our agent submitted it back. But again no response for more than a month after that.
We visited the unit last month on our way to the main office to file a complaint. We were surprised to see that the unit is being used to temporarily house a buyer for another unit (which is still under construction). The said buyer has been using "my" unit for about 4 months now.
I have already raised this problem with the developers, but I wanna know my rights.
* Can anyone help me and tell me what my legal rights are?
* Do i "own" the unit as of the time of bank payment even if the contract has not been signed yet?
* Do i "own" the unit as of contract signing a few months after payment has been settled? (update: new question added)
* Do i have the right to sue?
* If not, where else can I complain?
* What are my other options?
I hope someone can advise so I know how i can move forward with my case, if i need to get a lawyer, etc..
