Gusto ko lang po humingi ng advice kasi feeling ko ang unjust ng supervisor ko sakin. So dated march 25,26,27 umabsent ako due to medical concerns. Pumunta ako sa hospital nung march 25 and pinagrest ako ng doctor for 1 day. Immediately kong sinend sa supervisor ko ang med cert using Viber(Text Messaging App for Phone) and I'm already eligible to use my 2 Sick Leave. Nung 26 hindi ako nakapaginform sakanya na aabsent ako, but nung 27 is naginform na ko na baka hindi ako makapasok pero ittry ko parin. Now nakareceive ako ng letter na 3 days daw akong unauthorized absent. Which is from March 25,26,27 even though I submitted my medical certificate on March 25 using Viber. Ang tingin ko is pinalabas ng supervisor ko na tatlong araw akong absent na unauthorized kasi if we are unauthorized absent for 3 days matatag kami as AWOL. Ginawa niya yun para mabreak ko yung company code. Even though 2 unauthorized absent lang ako

I dont know your company policy but most companies considered unauthorized yung absence mo until mag file ka formally. So as of now unauthorized absence yung 3 days but after you file your med certificate things should get cleared up.

The thing is nakalagay sa letter na 3 days akong ncns even though 2 lang. Sinadya ng supervisor ko gawing 3 para mabreak ko yung company code

but that doesnt matter if ma cleared up naman after you submit yung medical cert. Just write your HR explaining your side and attach yung medical cert

Di ko po sure kung tama ba ang tinitignan ko pero binasa ko yung civil code book IV title VIII chaper III Article 1706 - Withholding of the wages, except for a debt due, shall not be made by the employer.

Medyo malayo na sa issue to sir/maam.
HIndi ka kasi nakapagfile ng leave kaya ginawan ka ng report ng visor mo. Trabaho nya yun, walang unfair dun. Wala syang hawak na dokumento galing sayo e, so pano nya ipapaliwanag yun sa boss naman nya?
Yung one day mo, actually pwede yun pumasok sa SL, pero kailangan mo ayusin yung mga papel pagreport mo kinabukasan.
Kaso nga umabsent ka..subsequent 2 absence mo unauthorized talaga, PLUS one day na hindi mo pa nafile as SL kaya nagtotal ng 3 days. You had to secure approval kasi bago ka mag absent/leave, hindi basta mawala ka sa work tapos iinform mo lang supervisor mo. mali yun.

Paano naman ako magfifile ng sick leave eh nasa bahay nga ako, I did the usual, informed him that the doctor advised me to rest for the whole day and sent him the medical certificate as soon as I finished my doctor's appointment.

kaya nga po pagpasok mo magFile ka ng Leave formally to cleared the 3days unathorized absence mo. Pwede naman po siguro sa Company nio ang late filing ng Leave lalo na po may valid attachments ka or ung Med. Cert mo.

Sir bakit ung sa company ko kht late file na yung medical certificate HND padn tnanggap specialy probationary p kme gnwa pong butas iyon kahit Alan ng lahat sa office Maps HR & Operation manager na na confine anak ko ongoing confinement palang po eh Alan na nila still tinaggal padin po ako?

Ma'am jonabelz HND po pasok sa illegal dismissal kc probationary pa lang po eh bka file na ma'am sa NLRC gusto ko lang malaman ang option or opinyon since waiting nadin ako sa arbiter desisyon
