I just bought the property in our subdivision. I know its gonna be sounds not right but were living in a subdivision that houses dont have title but were holding the deed of sale were not even paying for taxes or anything for the property but now its trying to sink in that i do really need to have title in order to have rights in the property that i already buy. So heres my question how i can be able to get a title if even the seller are dont have title of the land. I already have deed of sale which is signed by the buyer and seller and notarized by the lawyer. I actually dont know what to do now to get the title of the house.

Is it a subdivision not yet fully developed?
If Yes, then I suppouse the contract the seller have with the developer say you will get your title when some step in developing is reached or when a specified amount is paid to developer for your part (or some specific date). It's NORMAL the developer have title first, but when the house is done enough to move into, then the title is transfered to the new owner, and new owner get a (bank) loan which pay the unpaid part to the developer.
Ask the seller for a copy for the contract with the developer, or ask the developer to get a copy.

If No. Ask the seller what's the situation.

It's important to get the title (when it's time for that)
not only to prove ownership
but with title you can use it to get a loan at for instance a bank or Pag-Ibig.

Thanks for the reply. What i heard about our subdivision is "it is owned by the bank or by the government" but we are living there for almost 25 years and nobody trying to push us away from the subdivision. And now i bought a house in the same subdivision i was thinking who really owned that subdivision? How i can check who owns that subdivision?? my mom telling me it is just excess land that is why nobody wants us to leave in that subdivision. If nobody owns it? is there a way we can acquire for a new title.

Oh I thought it was a subdivision under development.

Then I suppouse it's a squatter type of subdivision (although when it has been such subdivision for many years, then it happen some of the houses can be both big and nice. In some cities the municipaly have given away the lots to the house owners.)

Such situations are often a big mess.
If it had been farmland, then I would have suggested you would have applied to get it titled,
but being in a subdivision it's very complcated and big risk an application for titling would NOT be approved. Expect high costs because a survey would involve many.

If you want to check it anyway you can
1, Ask other house owners there

2. Ask at the Municipaly office who own the subdivision.
If they answer the Municipaly, then you can ask if lots are leased out or what.

3. If you find any map there, and you can figuere out which is yours, then you have something so you can go on.

4. I suppouse you don't have any lot number or such from the documents you have allready. If you have, you can JUMP the above.
When/if you have any identification lot number, then you can::
a) Check at the Municipaly/Barangay property tax office, who have paid tax last and for which period. BUT that's NOT a proof of owning, it's just a hint.
b) It probably isn't, but if it's ever titled, then Register of Deeds have notes of title owner.

NOTE! It's risk you wake them up so they will demand much unpaid tax from you for long time back if there is such. Tax depts follow the Property UNDEPENDING of who was owner when the tax were suppoused to be paid.
So if you want to research it anyway, try to ask in general for the subdivision, until you know if you want to tell you is owner Smile

If it is a "squatter type" subdivision, you can ask if the officials have any plans for it.

Better do such researches before paying anything, so I hope you didn't pay much. But there are many such houses, so the risk you will lose it (soon) is small. But I believe biger risk someone official start thinking of it, if you ask them about it.
