Good day mga sirs.

di ko po alam kung ano pwede gawin topic title pasensya na po.

bale ganto po problema ko. I was hired by an advertising agency in singapore 2 years ago, actually po acquired po ng malaking advertising company yung dati kong company so for legal reasons I was made to sign a contract locally pero mag report pa rin po ako ng work sa singapore kasi i am a homebased web designer. naligaw na po ako ng department in the 2 years na nasa kanila ako, nagkaron din ako ng problema working with the singapore team. I was adviced to send my resignation letter sa singapore at effective yun by May this year (2016). So i was not expecting na may dadating ng salary ng May pero may dumating, that time kasi di pa rin ako nakakahanap ng trabaho, i tried to look for work pero ang hirap makahanap ng work talaga, upto now.. bale dumating ng dumating yung salary ko upto mid december tapos ngayon tinawagan ako ng HR ng manila office at sinasabing di daw nila alam na wala na ako sa singapore. Ngayon sinisingil nila ako sa naibigay nilang salaries sakin.

Ang tanong ko po, ano po pwede mangyare kung di ko mabayaran yung pera na naicredit nila sakin? at ano po pwede ko gawin kung di ko po rin kya mabayaran.

wala kasi ako pambayad dun kasi may binubuhay akong pamilya.

you could be charged with theft. Try mo makiusap and present them with a payment plan kung magkano kaya mo bayaran monthly. If amount is more than P12,000, penalty is 6 years in prison.

1. Ang tanong ko po, ano po pwede mangyare kung di ko mabayaran yung pera na naicredit nila sakin?

Pwede kang mademenda ng civil action for Collection of Sum of Money based on the 'Unjust Enrichment'.

2. Ano po pwede ko gawin kung di ko po rin kya mabayaran?

WALA. May karapatan silang kunin ang pera sa iyo dahil wala kang karapatan sa pera na iyon. Kung ayaw mo magbayad ay hintayin mo ang demanda sa iyo.

Theft may not be applicable in this situation because the element of 'Taking without the consent of the owner' in NOT present... ALSO the amount is not considered as 'lost' money which was found but unreturned. In this case, when the company sent the money, they sent the same voluntarily and with consent on the notion that the receiver has a right there but, in fact, none.

Theft is likewise committed by:
1. Any person who, having found lost property, shall fail to deliver the same to the local authorities or to its owner

These are examples that happened in the US.  There has been similar cases in the UK and NZ.
I wouldn't know if this would apply in the Phils but our legal definition of theft is the same naman.  I think ang position ng prosecutor was that even if it was credited to your account that money is not yours, so you took it without consent ng owner.  These examples however are banking errors so your case may differ.

Again i would advise you to consult a lawyer.  Mahirap na pag hahatulan ka ng judge tapos ang sasabihin mo "your honor sabi kasi sa forum di daw ako makukulong eh"

kasalukuyan ko po kinakausap yung HR na nagcontact sakin. hinihingi nya address ko pero ayoko pa ibigay, tinatanong ko about payment plans pero pilit pa rin nya hinihingi yung address ko.

takot pa ako ibigay address ko hanggat di nila ako nabibigyan ng remedyo sa dapat kong gawin..

ano pa po pwede nyo ma advice sakin sir?

yun nga di ko rin alam sir. alam ko madami ako na fill up-an na papeles sa kanila 2 years ago bago ako nag sign ng kontrata.. possible kaya na di nila naayos yun?
