Arresto Menor

Hi, is there a need to execute an extrajudicial settlement of estate if the property is a condominium that has not yet been transferred to the buyer. Last payment of equity will be on March 2017. However, the husband of the co buyer passed away on March 2016. Is the amendment of Contract to Sell be more appropriate than issuing an extrajudicial settlement?
