Hello po ask ko lang po if legally allowed po ba na yung 1 hr unpaid lunch hatiin sa dalawa taz yung pangalawa terminal lunch. 30 mins bago yung log out namen pinapalog out na kame na dapat nakaassign sa 2nd 30 min unpaid lunch pero di kame pinapauwi agad nag te.team meeting kame taz nag 10 days straight din kame ang naging gap lang from 1pm na log out to 730pm na log in the next day.. so in total 9 hrs schedule meron kaming dalawang 10 minutes break taz isang 30 minutes unpaid lunch.. niraise ko na sya sa supervisor ko at sa manager sinermonan lang ako.. matagal na ko sa bpo pero usually dalawang 15 minutes break at 1 hr uninterrupted lunch in 9 hrs schedule.. wala pong pumapansin sa concern ko sa office ee

Eto po schedule ko daily
7:30pm - 8:00 team meeting
8:00 - 9:30 Phone time
9:30-10:00 lunch
10:00 -12:30 phone time
12:30 -12:40 1st break
12:40 -2:30 phone time
2:30 -2:40 2nd break
2:40 -4:00 phone time
4:00 -4:30 lunch

4am pinapalog out n kme pero di kame pinapaalis nag te.team meeting kame.. paid by hour ako sa contract sa payslip ko nababayaran lang ako ng 8hrs in 9 hrs schedule
Eto nmn yung 10 days
Oct 16 Sunday 4am -1am
Monday restday
Tuesday restday
Wednesday 4am-1pm

good afternoon po ...ask ko lang po regarding sa SERVICE INCENTIVE LEAVE or SIL db po pag nka on year ka entitled ka dito?? every year po ba ito ?? for example po nka 2 years na sa company may SIL po ba ulit or one time lang po ito binibigay????

1. Silent ang batas sa paghati sa lunch periods. Hence allowed.
2. Anong 'terminal lunch'? saan mo nakukuha tong term na to?
3. Kung di kayo pinapauwi after ng work schedule mo, that is considered as OT as you are being mandated to stay. Hence considered as 'hours work'.
4. Mali ang ginagawa sa schedule mo. Ang nasa batas ay dapat (at least) merong 1 day (rest day) per week.

Sinubukan mo na bang magreklamo sa HR nyo? Kung wala kang gingagawa e malamang hindi aaksyunan ng management ito.

8 hours lang talaga ang sahod sa 9 hr schedule kasi 1 hr is lunch time which is not paid. meron naman syang rest day per week.

Terminal break lunch po ibig po sabihin yung hinating lunch po namen yung 2nd half po asa dulo n po ng shift nmen 7:30-430 po kame tapos po pinapalog out na po kme ng 4am (4am to 430am lunch po) pag logout nmen ng 4am.. n dapat lunch n kme or pwd na umuwi pinapastay po kame para sa team meeting so basically po yung dapat lunch nmen nagiging meeting (unpaid dahil nakalog out n kme) kaya technically 30 minutes lang po yung nagagamit nmen lunch na unpaid.. niraise ko n po to sa hr.. pero sinindak lng po kme.. tama po b pagkaintindi ko sa omnibus code book 3 implementation rule of labor code ung exception po sa shorten meals dapat po wala pong tatamaang ni isa sa conditions? More than 16 hours po operation hours ng account ko.. yung ibang account po di nman po hati yung break

Yung sa 10 days straight nmn po ang paliwanag samen may gap na 1pm monday to 730pm sunday kaya daw pwd daw un dahil 24hrs gap tawag po nila virtual off

aaah okie po salamat.. tama po ba yung intindi ko dito?
SECTION 7. Meal and Rest Periods. — Every employer shall give his
employees, regardless of sex, not less than one (1) hour time-off for regular
meals, except in the following cases when a meal period of not less than twenty
(20) minutes may be given by the employer provided that such shorter meal
period is credited as compensable hours worked of the employee:
(a) Where the work is non-manual work in nature or does not involve
strenuous physical exertion;
(b) Where the establishment regularly operates not less than sixteen (16) hours
a day;
(c) In case of actual or impending emergencies or there is urgent work to be
performed on machineries, equipment or installations to avoid serious loss
which the employer would otherwise suffer; and
(d) Where the work is necessary to prevent serious loss of perishable goods

yung 30 minutes po na last lunch break na pinalolog out na po kame tapos pinagmeeting po kame kaya bali in 9 hrs schedule 8 hrs po yung paiud ung 30 minutes po lunch yung last 30 minutes log out n po tapos team meeting.

if hatiin parin po nila lunch namen taz hindi na ilagay sa dulo ng shift valid na po ba yun o hindi pa rin po?

yung hatiin medyo grey area kasi labor code is silent if pwede hatiin. I think ang contention ng employer is yung total lunch period is still 1hr. Its just broken into 2. Ang mali dyan is yung required kayo mag attend ng team meeting na off hours. I think baka ang excuse nila is yung team meeting is not company sanctioned but just an initiative done by the team leader.

If hindi ka mag attend ng team meeting ano ang repercussions?

And lahat talaga 9 hours ang schedule and 8 hours lang ang paid. 99% of the companies here sa philippines ganyan ang schedule.

ah okie, so ang laban ko lang po na ginagamit nila yung 30 minutes ko na dapat lunch ee.. nirerequired po kame mag team meeting?
yung iba po kasing account sa office di nmn tulad ng scheduling sa samen ngayon lang po kasi ako nagka lunch na asa dulo in may 10 yrs experience in a BPO.. so hindi ko po pwede ibang laban yung section 7 kasi po medyo grey area sya?
so kung di po nila gagawan ng action yung complain ko. i have two option resigning or request to transfer in a different account? pasensya na po ang kulit ko. gusto ko lang kasi malaman kung tama po yung pagkaintindi ko sa rights ko..

pwede mo insist na dapat may lunch break but in my opinion mas maganda nga yung set up mo ngayon. Don't complain just for the sake of complaining.

Ask ko lang po hindi po ba talaga pwede na mag issue ang company nang coe kapag awol po..Biglaan po kasi ang alis ko nang basa that time kaya d po ako nakapag render nang resignation letter at hindi ko po nacomply ung 1month for clearance..Sa pagiging honest ko po nilagay ko po cya sa resume ko eh.hinahanapan po ako nang coe...nang papaaukan ko ano po ang dapat kong gawin..pls help..salamat po

pwede naman, pero syempre ayaw nila. Try mo ipilit, sabihin mo magfile ka ng complaint sa DOLE pag hindi sila nagbigay. Be warned though, pwede nila isulat sa COE mo na nag awol ka or any disparaging remarks they may think of
