Hi Atty.
Good day.
Here is the situation. A land property (DAR issued) already sold to a buyer and sold it again. The 1st buyer has already the notorized deed of sale. However the 1st buyer did not yet transferred the title to his name. It was like 15 years ago. Then now the original land owner's heirs sold the land to other (2nd buyer) and I think the second buyer already transfer title to his name. DAR has knowledge of the first sale but still they allow the property to be resold. Now the questions are:
1) Can the 1st buyer reclaim the title from the 2nd buyer?
2) What will be the cases can be filed in this situation?
Thanks in advance,
Manny
