Non Remittances of SSS

Hi sir,

Just wanted to ask, how could we file a complain with our company who is not remitting our SSS contribution even though it is being deducted to our salary monthly? Our company only paid the month of February for this year, but for January 2016 and March 2016 till present there are no contributions as per our online account in SSS. Our account manager already complaint about this with the site manager and HR, they told us that they would settle it. But months have passed and there are no changes whatsoever. The same thing is happening with my colleagues, not just me. I still have my payslips with me for this year, will that help?

Also, I don't want the company to know that I am the one who is complaining. As much as possible I want it to be anonymous. Could you give me some advice on what to do? And would filling a complain over the phone be possible?

Exhaust all the available remedies in your employee handbook regarding complaint procedures on employee contributions, even all the escalating procedures available. Make sure that all documents that you send and receive from the company are properly documented and copied. After all company protocols fail, gather all of your payslips and other documentary evidences you have and go first to the nearest SSS branch to inquire personally if your contributions are indeed being remitted.

If it shows from the SSS records that there are no remittances being done, ask for a copy and certification in their records that proves the lack of contributions sent by your employer. After doing that, go to the nearest Regional DOLE office and seek their advice regarding your matter. Alternatively, you may go to the nearest Public Attorney's Office to seek free legal advice.

Right now, I'm no longer with the said company. Will give them until November to pay our SSS, if they won't comply, then i'll take your advice. Thank you!
