It started last August or September when a certain Ms.Jhosie (my Lola's neighbor) introduced us to the owner of a unit in that compound. They offered us to sell the house in the amount of 300k in cash and the balance of 219k in Pag ibig. We did not settle in this agreement since they want it in terms that we cannot give, Plus the 300k cash became 350k. In a matter of time, they came to us (to my wife), and said that they're adjusting it to 275k in cash plus the loan balance. They said that they just need a down payment of 100k for a reason and that they are willing to accept the installment term that we offered before.
Hindi pa din kami agad umoo since we need to plan carefully dahil ayaw naming magpabigla bigla. Matapos ng ilang panahon, pag uwi ko pra magbakasyon, nagkasundo kami na after magbayad ng downpayment, maari na kaming lumipat sa bahay para magamit yun habang binabayaran ang cash installment.
Lumipas ang panahon at nagsimula ang aming monthly payment. Buwan ng December, nagssalita yung owner ng bahay na advice ng lawyer daw nila na hwag munang patirhan ang bahay habang naghuhulog pa. Nagreact ang aking maybahay dahil di iyon.ang kasunduan. We told them na pagdesisyunan agad kung mgpapalipat o hindi sa bahay dahil balak na naming ihinto ang usapan. then the owner said na kung iaadjust ko or "i-fast track " ang payment ay gagawan nya ng paraan na palipatin kame. Nakaramdam kami ng alinlangan pero pinili namin ang magtiwala sa mag asawa. Instead of 20k per month na napagkasunduan namin sa conditional deed of sale na notarized last Oct 28 kung kailan namin ibinigay ng cash at buo ang 100k, ginawa naming mag abot ng mas malaki. (we have aknowledgement reciepts each payment with signature of both parties).

Meron po kaya kaming laban kung magpafile kami ng kaso laban sa kanila? gusto ko na lng po sanang ipabalik na lng yung pera dahil wala namang nangyayare, ni hindi kami nakalipat which is bakante yung bahay dahil hindi sila doon nakatira na, at may problema pa ho pala sila pagibig, nagfile yata sila ng complain sa pagibig, sa dami ho ng alibi nila parang walang nangyare sa pinaghirapan ko dito sa abroad.

if your deed says you are supposed to get possession and they are preventing you then you can go to court and either demand that they fulfill their obligations or you cancel the agreement and the money returned.

What if sir kung pumayag silang ibalik yung pera pero maghihintay pa kaming mabenta ulit yung bahay which is may ongoing case nga yung bahay on pagibig so matatagalan po yung, hindi naman po yata makatarungan yun sa amin. nagbigay kami ng pera ng hindi na nga napakinabangan tapos sila pa tong magdedemand sa term ng bayaran? pwede po ba yon?

it's up to you if you will agree to those terms or you can reach a new agreement acceptable to both of you. or if no agreement, your legal remedy is to go to court, or try the bgy first.
