Binakuran po nila ung lupa na 15 years na naming inimprove at ginagamit. Importante po sa amin ang lupang ito kasi ito ay daluyan ng tubig papunta sa aming sakahan. Ang ginawa po namin ay pinasok din namin at bakuran din sana sila pero pinigilan kami at nasira ang ilang poste ng bakod nila. Kami pa ngaun ang kinasuhan ng malicious mischief, ano po ang gagawin namin? nangnganib ung mga palay namin na maaring matuyuan pag kinontrol nila tubig papasok sa nasabing sakahan. i'm not an expert in the water code, but I would use this provision to defend you:

Article 49. Any person having an easement for an aqueduct may enter upon the servient land for the purpose of cleaning, repairing or replacing the aqueduct or the removal of obstructions therefrom.

Thank u for the info atty, we were totally shut off from the canal/waterway. We are in the process of filing forcible entry against them, but until this is resolved, our farm is at their mercy. Thank u !!!
