Hi atty,

This lady sold her share of land already but still she pawned it. The supposed to be owner now cant have any products from the farm because. it is pawned for 200,000.00.

So what would be her case?

to my mind the buyer is entitled to a civil case for damages and enforcement of the sale, but not the extinguishment of the mortgage unless it can be shown that the mortgagee was aware that the lady was not the owner.
