Swendling for not finishing a system project for student

Ako po ay programmer, meron po na student na lumapit sakin para magpagawa ng system, ito po ay thesis nila, at nagkasundo po kami sa price at kung saan lang yung system na gagawin ko na naka depende sa instruction nila at ito po ay walang kasulatan, verbal lang kami nagkasundo, natapos ko po ito at nakuha ko na ng buo ang bayad, pero kada pa check nila ng system padagdag ng padagdag yung adviser nila at sabi ko sa kanila dagdag kabayaran na rin yung update kasi wala sa usapan namin yun, 4 times sila nagpa update sa system at yung last hindi na nila kinumpleto ang bayad para sa update, ngayon nag defend na sila ng thesis at may revision, magpapagawa sila ulit ng revision sakin pero tinanggihan ko ito kasi nawala tiwala ko sa kanila dahil yung last di kompleto ang kabayaran ng update, kaya sabi ko kung magbabayad din naman kayo sa ibang programmer nalang.

Ngayon po gusto nila mag file ng kaso sakin ng swendling dahil hindi ko raw kinumpleto yung system nila, sabi ko naman hindi ko na obligasyon yung revision kasi dapat pinag aralan nila yun ginawa ko at sila na dapat gumawa.

Tanong ko lang po kung may chance na makasuhan ako ng swendling kung mapatunayan at ano rin po ang i file ko against sa kanila kasi nagtatrabaho po ako sa ibang lugar ngayon at madidisturbo ako o mawalan ng trabaho kung sakali i summon ako sa court?

Yung time po pala na ginawa ko yung last update ay nandito na po ako sa manila kasi may employer na nag hire sakin at sila po ay nasa probinsya, ngayon pinapa barangay nila ako at sabi ko naman kay misis wag ibigay ang contact details ko kasi hindi pwede ako umuwi ng province at malayo saka baka matanggal ako sa trabaho, sa ngayon ang nirereklamo nila sa barangay ay si misis kasi yung last na kabayaran sa update sabi ko ibigay nalang kay misis, wala si misis alam sa usapan tungkol sa thesis na pinagawa at alam niya lang na bayad nila ito saakin, ngayon pati si misis nirereklamo sa barangay kasi kasabwat daw, at bago napunta sa barangay inassault muna nila si misis sa bahay at walang naisagot si misis sa kanila kasi nga wala siyang alam.

Ano po ba yung pwede nilang i file na kaso kay misis at ano rin po ang pweding ibalik ni misis sa kanila na kaso, nag search din po ako, baka pwede po libel or slander, tama po ba?

Patuloy mo lang ang pagreresearch ng possible violations ayon sa Penal Code para malaman initially kung sino ang tama. Mahalaga na klaro ang mga unang usapin:
1. Ano ang original agreement? Hanggang saan ang deliverables sa programang ginawa mo? Kanino ang ownership?
2. Noong pumawag ka sa revisions, ano ang bagong agreement?
3. Paaano nanaman nabali?
4. Ano ang charges sa Barangay?

Magtanongtanong din sa iba. Perspektiba ko lang ito ayon sa pagkakaintindi ko. Paki validate at icorrect kung may di tamang intindi.

They suing me of swindling for not doing the revisions and it is not my concern anymore because its not part of the original agreement and it is already 100% done, yung revisions ay panibagong agreement naman po yun, saka ayaw ko na rin po tanggapin kasi yung last payment nila saakin para sa update ay kulang at kay misis ko ipinaabot yung bayad nila at binaniwala ko na po kasi busy na rin ako sa bagong trabaho ko at sinabi ko na sa iba nalang sila magpagawa ng revisions kasi wala na akong tiwala sa kanila.

Kasi lahat naman nagawa ko at 100% pwera lang sa pinapagawa nilang revisions.

At bago po nila pinatawag sa barangay si misis nakiusap sila na gawin ko daw yung revisions, sabi ko naman walang problema sa akin basta bayaran yung kulang at mag hingi ng pasensya sila kay misis dahil sa pag sisigaw nila sa labas ng bahay pati yung 4yrs old kong anak natakot sa kanila.

Yung reply nila sa text kaya nilang bayaran pero di nila kayang humingi ng pasensya or mag sorry kay misis kaya di ko na tinanggap yung revisions.
