My husband was caught masturbating on public, he recently lost his job and had a troubled childhood, he said that he was depressed. The problem is a minor saw him do it. Can we use the depression as an alibi, he did not touch the girl, she claim that he saw him. Please help.

An alibi of being a depressed person will not exempt him for the crime committed but rather it would reduced or only mitigate his criminal liablity.
