Hi Attorney,

6 mos na po ako sa company and regular na po ako. and ngayon po i really want to resign but i have an employment bond for 2years and if I breach the contract magbabayad po ako 100k.
here the statemnet po sa contract ko.
"That in the event of EMPLOYER's resignation or termination for reasons such misconduct, ineffeciency or violation the companyrules before 2 years are completed, EMPLOYEE agrees to reimburse (company name)the minimum amount of 100K investment in training and/or development of skills of the employee"

wala pa naman po aq formal training,basta inexpose na po ako sa work then if may question ako then pede ako magtanong sa senior ko.yung lang po yung naging way kung pano ko naging familiar sa job. Buy asking and reading in some documents and materials sa pc. So clasify na ba yun sa statement nila na "investment in training and/or development of skills of the employee". la po aq money to pay the bond pede bo ba ako makulong qng d ako makakabayad? saka makakasuhan ba ako? licensed engr po kasi ako baka mkaaffect to sa license ko..pede ba marevoke license ko?

I need an advise about the case I filed for my past employer, just last week nagpunta po ako ng Labor para sa money claims q po...

meron pong bond of 15k ang kontrata ko,sa BPO industry po aq nagtratrabaho. Nag start po aq last October 5,2011 tapos my 1 month training po un.

Eto po ang nakasaad sa agreement: Training Agreement

"The participant shall also oblige himself to maintain employment with the company for a period of six(6) mos from the termination of training. If the participants however decides to resign from the company or is dismissed for any violation of the company policies or any cause under article 282 of the labor code, including intentional under performance, before the end of his/her contracted employment period of six(6) mos starting from the completion of the training period, the participantshall be obliged to indemnify the company for the Philippine pesos: 15,000.00 or the investment amount that the company made fr the training of the participant, whichever is higher."

Yan po mismo ang nakalagay sa contract ko.

Tapos after ng 4weeks training Pumirma po ulit ako ng Probitionary Contract( hindi na po nakalagay sa probitionary contract ko ang Agreement bond na 6mos for 15k)..

pero naterminate po ako on March 28,2012 dahil sa QUALITY ASSURANCE (Q.A), mis-treat daw po... the same day pinaperma nila aq ng termination paper.(wala po silang binigay na copy ko)wala na po aq nagawa pumirma na po aq...tapos ang sabi sakin ng account manager ko magpasa nalang aq ng resignation letter para kahit papaanu maganda ang records ko sa HR. so after 3-5 days po ngpasa po aq ng resignation para kahit papanu makakakuha aq ng employment records..

nagpaclearance nadin po ako.. at ang sabi sakin after a mos makukuha ko lastpay ko.After
1 mos tumawag po ako para follow-up ang backpay ko, and sabi wait pa aq ng 1mos pa.kc 2mos daw bago makuha ang backpay.

After 2mos tumawag po ulit aq at ang sabi sakin di ko nadaw po makukuha ang backpay ko kc ang probitionary contract ko ay connected pa sa unang training agreement na pinirmahan ko.

Gusto ko lng po sana malaman ang karapatan ko makuha ang para sa akin. and besides po, mag six (6) mos na po dapat aq sa company by April 5, so ilang days nalang bago nila aq tinerminate. So I hope, in terms sa bond na sinasabi sa training contract patapos na aq doon.

gusto ko din po malaman na from the time na nagsign aq ng probitionary contract Valid padin po ba ung Training contract ko? o hindi na po.

at pwede padin po ba nila idahilan na under aq sa training bond kaya di nila mabibigay back pay ko kung ilang days nalang po ay 6mos na aq nag stay sa company?

my hearing na po aq sa labor nextweek, gusto ko lang po magkaroon ng idea kung anu ang pinapasok ko at kung my laban po ba ako.

Hi Sir Smile I'm currently a virtual Accountant and i signed a 1year bond contract where it states i have to pay 100K if i resign before 1yr to cover training costs. i have no resignation issues yet but i'm just curious about the nature of my contract. if it's enforceable. they did not train me, the company that is, but i receive random trainings from the client for the accounting softwares they use. is this bond enforceable? or we are just being threatened? thank you! this site is awesome by the way! probationary contract is useless since you are pro-b since the day you hired below 6mos except if you're for a fix term contract.

Atty, is it valid to pay unserved revenue of my employer if ever I resign and will not finished a fixed term contract?

my contract is for 1 year. nakasaad sa contract Subcontractor daw po ako 2% un tax at wala daw benefits. tama po ba ito? hindi po ba ito labor only contracting?

atty. subcontractor daw po ako pero nakadeploy po ako sa Client. IT programmer po un work ko. When it comes to work the client supervise me then sa payroll un employer ko.
No work no pay po kame. Even holidays were not paid. kaya sana gusto ko po malinawan if legitimate po. Maraming salamat po attorney.

imo, this is arguably labor only contracting. if you will resign, tell them that you will file a case against the client also

Hello attorney patulong nman po..

ako po ay isang empleyado ng isang malaking kumpanya dito sa pilipinas. meron akong napirmahan na kontrata na tumatagal ng 7 years. naka pag silbi na ako ng 6 years and 8 months.

nag file ako ng resignation letter nung marso at ang effectivity date ng aking resignation ay tatagal ng anim na buwan 6 months dahil sa nagpalabas ang POEA ng memoramdum circular na ang aking position ay pasok sa mission critical skills. hindi pa man natatapos ang anim na buwang abiso sinulatan ako ng hr na kailangan i fulfil ko daw ang nasasaad sa aming kasunduan. matapos ang anim na buwan ako ay nagpasyang mag extend ng another 2 months sapagkat ako ay sinisingil ng buong halaga ayon sa kasunduan. nang matapos ang panibagong dalawang buwan ako ay humihiling sa kumpanya na tatapusin ko nalang ang aking kontrata para wala akong babayaran ngunit hindi na nila ako pinayagan pang mag extend pa sa kadahilanang puro daw ako sick leave without pay.kung baga pangit na ang performance ko. sa loob ng isang lingo minsa 3 times aweek lang ako pumapasok o 2 times a week ung iba SL na wala namang bayad.

Eto po ang aking katanungan:

1. ano na po ang maaring mangyari sa aking kontrata? kailangan ko pa bang magbayad sa kanila ng buo? sinubukan ko ng humingi ng pro rated sa aking babayaran d sila pumayag.

2. ako po ba ay maaari nilang kasuhan? willing naman ako tapusin sila ang may ayaw.

sana po ay mabigyan nyo po ako ng kasagutan sa aking mga katanungan..

Hi Attorney,

Nagseek na po ako ng advice sa inyo nakaraan regarding po sa Company namin na ng bond for Airplane ticket etc. Hinge ulit po ako ng tulong sa inyo regarding ulit sa Company issue namin Sad Yung Current I.T. Company po namin is nilipat po kami ng pwersahan (hinde pa sasahurin if ever di magsign) to other Company which is sa Kanya rin (Possible reason from Regularization to Contractualization). Ngayon po since bagong Company na kami upon signing ng contact meron kaagad ng Contract Bond for 200% ng Sahod namin if ever mag resign kami.
Also kami narin magbabayad ng buong-buo ng SSS namin Pagibig and Tax. Di katulad dati na 50% percent subsidy ng Company
Ang tanong ko lang po since masyadong magulo na itong I.T. Company na 'to! I'm Planning to file resignation. Possible po bang habulin ako ng May-ari dahil may pinanghahawakan sila? If ever naman habulin ako ano po pwede kung gawin upang ma counter naman sila or ma defend ko yung sarili ko.

Hi Attorney,

New member seeking advice regarding my employment bond,I joined the company last January 3, 2011 and signed the contract covering a minimum 2 years of service w/ the company.My contract/bond ends by next year January 3, 2013.

I am planning on resigning from the company next year, and for that matter I need a month notice before the effective date of the resignation.

The situation is that, if I send the letter/email today or tomorrow the effective date would be on January next year of the same day and that is past my bond already from the company.

My question is, will there be any impact/ issue on my side of the contract if I plan to send a month notice prior the end of the employment bond?

good evening ATTY.

just need an advice. hopefully you'll give me an enlightenment. I am hired last April 2012 in a school here in the province. Because of my eagerness to work in a school set-up. I signed a 5 year contract. may nakalagay na bond doon pero as far as i remmeber, walang reason yung bond na yun. e wala naman ako naundergo na formal training related to my work. My contract starts june of 2012. pero nagsign ako ng april. nagstart na ako pumasok ng april but nakita ko how the system and management of the school works. so i gave a 30 day notice. pero kinausap ako ng president and told me na kahit one year lang. so pumayag ako. now plano ko nlng tapusin po yung academic year. dahil ayaw ko talaga pamamalakad ng school. eto po tanong ko

1. pwede po ba nila ako kasuhan ng breach of cobntract and force me to pay for the bond na hindi ko naman alam bakit may ganun.

2. what if pinilit niya pa rin ako magstay and tell me see you in court even if i gave them 30 day notice that i will leave the school?

if and if lng they file charges against me, anong chances ko po?if nanalo sila sa case, may record na po ba ako non sa NBI or whatsoever.. Thank you po..

nagtrabaho po ako sa isang bpo company ... nangyari po na nagkasakit ako at hindi na nakapasok .. nung time na papasok po ako eh nanghihingi na po sila ng maraming clearance .. and then nagpadala po sila ng letter last sep.19, 2012 para sa hearing sa office dated oct.02, 2012 pero dumating po ung letter ng oct.16,2012 then after a few days ay natanggap ko ung termination letter kasi di daw po ako sumipot .. late din po ung termination letter .. and then suddenly this day january 11, 2013 ay nagpadala po sila ng letter na naniningil po ng bond. ang nakasaad po ay youshould accomplish to pay this ten days after the date of the letter which is january 03,2012. sabi po nila magffile sila ng kaso .. ano po ba dapat ko gawin sir .. at di rin po pala nila nabayaran ung philhealth ko po .. they asked me for the requirements for times and I submitted it po .. pero lagi parin po sila nag aask ..

Good Day,

I would like to ask, if a training bond can be notarized if I erased the amount 250K and said (amount to be determined)then signed it.

If yes, will there be a possibility that they will make it higher? My mistake was I should have written the exact amount I wanted to pay. I was demanding that it should be lower than 250K because the expenses I compute is lower.

If in case they file a case of unjust enrichment or breach of contract.... there is an obligation to pay.... but what if I dont have money nor any property to pay them, will they get it from my spouse or my parents property?

I am currently employed in an agency, and we were given a contract in which wasn't explained to us so we were left to interpret the contract ourselves (most of us interpreted it that we are bounded to that company for a period of 2 years). Then two weeks ago we were asked to pass a letter of intent whether or not we plan to stay with them and so I did.

Now, a few days later I heard that we can still resign WITHOUT paying the liquidation and compensatory as long as its during summer vacation.

My question:
1. Even if I filed a letter of intent, could I retract my previous statement and give them a letter of resignation? I know letters are non-binding, I just want to make sure.

2. Kung nkalagay nman sa contract na 2 years dapat kmi mag work sa company, bkit po sila hi2ngi ng letter of intent?

Our company provided training however we are considered TESDA scholars and therefore it has been paid by TESDA. How come they have a bond? are they allowed to have a bond?
