Hi po, ask ko lng po kc I am legally married sa una & separated. May family na rin po sya & so am i ngkaroon ng kalive- in & had 1 son. Inacknowledge ng klive in ko yng bata by signing the birth cert. ngayn po d na rin maganda relationship nmin & i will be leaving soon overseas for student visa with work po. Ask ko lng po just incase mgffile sya custody ng bata which i dont want na maiwan sa knya ang bata & i prefer maiwan ang bata sa mom ko together with my 1 daughter . Possible po ba to? pwede nya po ba kunin ang bata sa mom ko just incase nsa abroad po Ako? Or if he filed for a custody while im still here he can get po ba agad ang bataif ongoin ang case? As of now po la po ako trabaho kc waiting sa visa ko bka kc po yn ang basehin nila for unfit mom para mkuha ang bata. 3 mos since we separated po never nman po ako ngdemand ng support. Thanks po.

Sa case mo, ang full custody ay sa para sa ina. Ang visitational rights ay maaring hilingin ng ama na kailangan i approve sa korte with your consent. Visitational is pagbisita ng ama.

Ang temporary custody ay maari ding hilingin at/o mapagusapan sa loob ng korte with approval at consent ng ina.

Halimbawa ng hiling ng ama, temporary custody tulad ng isang beses 1 buwan sa tuwing Sabado o Biyernes halimbawa ay sa ama ng bata matutulog ang bata, depende ito sa hiling ng ama , sa approval ina at sa court imho as long as wala namang grave threat ang ama sa piling ng bata na mapapatunayan sa loob ng korte.

Oo hanggat nasasakop ng Pilipinas ang lugar na kung saan sya nakatira.

Kung hindi ka papayag naman eh nasa sa iyo din iyon, maari mong sabihin ang intentions mo sa court. Hanggat hindi pa nakaka desisyon ang bata para sa kabutihan ng sarili niya, nasa iyo ang full authority at care bilang ina ng illegit child.

I presume that when you say, "separated" with your first husband, your marriage is not yet annulled. And having a child with another person would make things complicated in court. May advice is this, make extrajudicial settlement with the biological father of your son. Meaning, talk it out and make agreements outside court. This agreements between parents should prioritize the benefit and welfare of the child and not the parents.

I tried talking & settling things to my sons biological father but seems getting more complicated with his mom on his side & doesn't want to settle at all. Im just preparing myself just incase he would file for the custody.

Confidently he wont file especially he knows about your prior marriage. But he does it would not prosper. In your situation, the mother has ful custody of the child.
