Hi! I would like to hear your opinion on this sir and mam. Ang employer po namin ay magpapatupad ng contractual beginning 2016. Ang siste ay one-year contract per employee. Naging ganito ang agreement dahil may mga nagreresign at ang welfare ng org ang nagsa-suffer which is true and they also said that resignation is not allowed once we signed the contract. Here are my queries:

1. What if there is a need to resign with valid reason/s but the employer rejects it because of the existing signed contract. Is there a breach of contract?

2. There are regular employees, including me, which was told also that I will sign the said contract too. Do I need to sign it?

Thank you. Please enlighten me sir and mam.

1. Just as long as you tendered your resignation and rendered the 30-day period, there is NO breach of Contract to speak of.
2. Check the document/contract, if your rights and privileges as a regular employee will diminish, you don't have to sign that document or any document for that matter.

NOTE:

NOBODY can stop you from resigning. (But you may be bound by contracts, if the situation calls for it). Not even the President of the Philippines. Otherwise, it would tantamount to 'INVOLUNTARY SERVITUDE' and no less than the Constitution proscribes it.
