Naaksidente father ko last april 2015, holy week. Naka motor siyang pumunta sa supplier ng tindahan naming to claim his prize on reaching the quota. Sa east-service road, south super highway Paranaque nangyari yung pagbangga sakanya. Magtuturn left sya papasok ng gate ng supplier naming, naka signal naman sya. Nung clear yung daanan at papaliko na sya biglang may sumalpok sakanyang motor din, parang big bike. Sa lakas ng salpok tumilapon yung father ko at gumulong gulong and muntik pang masagasaan isang jeep. That time may guard naman na nakkakita pati tinabi naman ng nakabangga yung motor nya, nilapitan nla yung papa ko para tgnan kung nakadilat or hindi. Tapos nagdatingan yung mga kasama nung nakabangga. Grupo pala sla na nagmomotor at nahuhuli sya kaya siguro mabilis takbo nya.Humingi ng tulong si papa para maidala sya sa hospital dahil hindi na sya makagalaw at sobrang sakit ng left arm nya. Inangkas siya sa motor ng isa sa mga kasamahan nung nakabangga sakanya. Pag dating naming sa hospital kinausap kami ng doctor sa emergency room na kailangan mag undergo ng operation father ko dahil sa naputol yung buto sa “neckline”. Nung time nay un wala kaming idea kung anong nangyari dahil hindi makausap yung father ko sobrang takot and pain na nararamdaman nya. Kinausap naman kami nung lalaki na nakabangga sakanya, nag thank you pa kami dahil tinulungan niya yung father ko at dinala sa hospital. Akala naming maayos siya at mga kasama niyang kausap. They gave their phone numbers where we can reach them. Umalis sila after dahil may hinahabol silang biyahe sa Mindoro. After nang pag alis nla, the doctor said na kailangan ma-admit at ma obserbaran father ko before his implant operation. I tried to search the guy na nakabangga sa father ko via facebook and sent request on him, he accepted me and started to tell hm about my father’s condition but after 2 or 3 days of waiting he replied and said na hindi siya nakabangga sa father ko instead father ko ang bumangga sakanya.I also texted him to his number but it takes 2-3 days before he replied until in-unfriend niya na ko sa Facebook and his not replying on my texts while he is actively posting pictures on facebook taken from their trip to Mindoro. Since father ko yung na aksidente, wala kaming idea na we need to report to pulis etc what happened until my father insisted it. All girls kasi kaming magkakapatid and then first time tong nangyari sa family naming dahil ang work lang naman ng parents ko is walking distance sa house naming because they are businessman. We reported what happened and invite the guard to give his sworn statement and we also request to copy the cctv footage to their management and submit it to the pulis. NOW, they are undergoing in a mediation sessions. Yung side ng nakabangga kay papa nakiusap na kung pwede wag ituloy yung case, so pumayag father ko na pagusap under the mediation, Nag bigay ng amount yung father ko bayad sa mga expenses na ginastos naming because of what happened. The mediator asked my father if he can present receipts of the said expenses. My father said he can present receipts pero hindi lahat masusupport ng receipts since some of the following refuses and not giving receipts like: Other taxi drivers, Follow up checkups with doctors, etc. but still nag agree yung kabilang party that next mediation session my father will bring the receipts he can present and they will pay half of the amount my father demanded. But, nung nasa mediation na ulit and the mediator expecting na dala nila yung half ng amount. Hindi sla nagdala and demanded na ang babayaran lang nla kung ano yung mga nasa receipts. We explained na, yung hiningi naming amount is accurate sa nagasotos namin. Pag follow up checkups hindi naman nagbibigay mga doctor ng receipts per punta naming, yung nag undergo ng therapy father ko hindi naman sila nag issue ng receipts, taxi fare and yung MONTHS na hindi nakapag work father ko,, Almost 8 months hindi siya nakapag work before and after the operations. Yung loss earnings included yun sa hinihingi naming pero yung sahod lang ng papa ko hindi kasama dun yung sinarado namin yung tindahan ng ilang days.

Is it counted kahit walang receipts? since understood naman na ilang months father ko hindi nakapag work dahil don and until now kahit naoperahan na siya, hindi niya na mataas ng maayos kamay niya? And yung evidences ba ay sapat na to win the case? Ang nangyayari kasi sa mediation yung nakabangga sa father ko yung nagdedemand na gantong amount lang ibibigay nila. Please give me your advices on what we can do. Hindi ko po kasi alam what to ask exactly so i just said the scenario. THANK YOU IN ADVANCE
