Need some advice what to do

dalawa kami nagwowork dito sa company na ito na.2 yrs and 7 mons na ako as I.T. Technician at yung kasama ko na janitor na nasa 4-5yrs na yata na nagwowork din dito.

direct hiring ako, no contract at all..start kagad pagkanext day after ng interview. yung kasama ko na janitor ntransfer sa company na ito(dati sya sa isang company na may benefits), sa pagtransfer nya daw wala sya pinermahan na contract so ang alam nya as is pa rin ung contract nya sa previous company(magkakilala kasi ung boss sa both company na yun)

starting salary ko nun is 12k(fixed) then nagincrease after 6 mons to 15k(fixed until now)(with the help of a japanese worker because of my dedication sa work). ung sa janitor namin ang alam ko salary nya nun nasa 12-13k yata un then naging fixed na sa 14k.

wala kami benefits na nakukuha..no SSS, no philhealth at wala rin 13month pay.

part kami sa admin office..sumusweldo kami ng kinsenas.cut-off 10 25 ng bawat buwan at release ng sweldo eh kinsenas. nag-usap kami na alam namin na regular na kami dito at dapat may karapatan kami para hingin ung mga dapat na hingin namin. ngunit di namin maasikaso dahil sa ibang bagay na rin na ginagawa namin sa araw-araw. may plano na kasi kami na umalis dahil sa bulok na sistema ng company na ito.

pati ibang linya ng trabaho ginagawa na namin dito mula carpentry at pag eelectrical wiring. pag wala ung janitor namin ako na rin yung nag-aasikaso sa mga gawain nya.

then may witholding tax(2%) na binabawas samin simula nung nagkaaberya sila sa BIR. kinuha lahat e2 sa lahat ng empleyado mula sa mga freelancer na teachers at sa mga nasa admin din. dati wala kami bawas nun based sa payslip namin.

dati nakakahiram kami ng pera(cash advanced at loan) ng walang problema ngaun pahirapan na at minsan dedma lang kahit dinirect ko na sa boss namin na japanese ung kelangan ko. pati sa lates namin na super magkaltas..after 3 lates, bawat 30mins na late kaltas na ng 50 pesos kahit 1 min lang kaltas pa rin, wala man lang consideration.

may laban kaya kami at may matatanggap kaya kami na halaga sa pag-alis namin kung ipaglalaban namin ito?

yung company namin, may mga employee na nagtuturo ng english sa mga japanese at iba pang lahi. ung mga empleyado na yun daw ay tinatawag na freelancer lang.eh kami di na kami sakop doon kaya alam namin na may rights kami at kaya gusto rin namin ilaban ito.

may inattach ako dito na image ng payslip ko at payslip ng janitor namin at ung dating payslip ko na walang tax. iniisip namin kung pwede namin gamitin e2 as evidence?

Here are some related things:
You not complaining about it over a year (?) can make it harder. But not sure you have anything to complain about, because they have given you the money with less/no deductions for tax and fees.

"Frilancers" CAN get the 13th month pay INCLUDED in the pay DIRECT.

A question is if such jobs are allowed to be counted as "frilancers". I believe YES for teachers, I don't know for janitors. An other question is if you have got compensation for the PART of the fees the employer pay otherwice.

I don't know if it's legal for employers to make the "frilansers" handling tax and fees direct, but it would NOT be odd if it's legal, because it is in some other countries.

An perhaps odd thing: Why 2 % tax deducted?
Income tax under 10 000 is 5 % and above that 10 % after deductions for for instance having dependants you support.
Perhaps the 2 % is related to the ODD LAWS the Philippines? I know have about some OTHER things, when BIR demand WRONG person to handle tax paying. (E g tennants have to handle tax for landlords!!! )

It's 2% tax withheld at source for contractors, sub-contractors and other similar services and they are classified as such.

It means they have to file the proper taxes directly to BIR.

thanks po for the clarification about the 2% tax. yung sa 13month pay po may makukuha kami if plan namin na magfile ng complaint sa dole? medyo pagod na kami sa company na nito at balak na namin umalis, baka sakaling may makuha kami at magamit namin yung pera na yun pang process sa ibang work na kukunin namin.

As I wrote it's allowed when it's counted as freelancer to INCLUDE the 13th month pay in each month pay, so it can be have been PAID allready.
