Regarding Immediate Resignation & Bond-pls help

Gusto ko lang po maliwanagan. Ang situation ko po ay ganito. Currently I am working for an incorporation, ngayon pioneer team po ako ng isang brand nila. Nagstart ang training namin ng June 2015, they made us all sign a bond amounting to 60k. Naka probi po ako until Dec 2015.

Right now, gusto ko na umalis because 1) kahit team leader po ako, hindi yun pinaparamdam saken ng admin, 2) sinabihan po ako na "hilaw" pa ako para sa posisyon na ito, 3) ang lakas po ng pulitika sa kanila, meaning may ibang supervisors/TLs na hindi sumusunod sa house rules pero hindi narereprimand, 4) 3 months of operations, wala pa rin ang Service Charge namin, 5) I don't feel there will be growth anymore despite of realizing na startup palang kame

Na-demotivate po ako dahil dito. Ayoko na pumasok pero pinilit ko, until such time, last Oct 15 hindi ko na talaga kaya pumasok dahil sa sabi po ng mga staff ko ay nariringgan nila ang OM namin na bina-backstab ako. Gusto ko po sya ma-confront but I did not do it dahil ayoko na ng issue. Oct 16 nagpaalam po ako na aabsent ako, pumayag naman po ang immediate ko. Oct 17, hindi na ako pumasok ulit dahil ayoko na po talaga, nagSMS ako sa immediate ko at nag apologize at sinabi ko ang totoo, pero ang reply nya "Wag kana magreport bukas. Mag file kana ng resignation."

Tama po ba yun? If I file my resignation, liable pa rin ba ako sa bond when in fact sa kanila na po nang galing na magresign ako?

Gusto ko lang makuha ang COE ko sa kanila. May right po ba ako makuha yun inspite of not paying them any bond?

Sana po ay matulungan nyo ko. First job ko po ito. Right now, I feel depressed about this.

Ikaw mismo ang nagsabi na hindi ka na pumasok, so ibig sabihin balak mong mag awol.

In theory, tama lang naman na sabihin sa iyo na dapat mag file ng resignation kung di ka na papasok.

In being honest Naman with her, di ko sinabi na ayaw ko na pumasok. Ang sinabi ko po is yung situation ko na ganun, demotivated ako. But instead nireply nya is mag resign na ako.

Update: I asked our admin manager regarding my resignation and I told her na willing po ako mag render ng 30 days but sabi nya is magresign na po ako immediately. At ganun din po ginawa nya sa isang co-worker ko.

while in theory bawal magsabi sa employee na mag-resign, ikaw mismo ang nagsasabi na demotivated ka.

Hi attorney, meron akong gustong iconfirm. Naapektuhan na health ko dahil sa madalas akong magOT, 3-5 hours araw araw. Ot without pay yun. Hindi ko ginusto magOT dahil me kota kami. Hindi pa ko pwede mag resign kasi me bond kami. Dapat 1 year ang stay para malift ang bond. 6 months pa lang ako attorney. Nag pacheck up ako sa doktor at ang advise pag natuloy pa to worst health issue na ma encounter ko. Pinakita ko sa supervisor ko ung med cert at ang advise nya pag babayarin daw ako ng bond. Hindi ba valid ang reason ko para mag resign ng hindi nagbabayad ng bond? Thank you po.

Nasa kontrata ba na merong mga sitwasyon na pwedeng magresign ng hindi nagbabayad ng bond o danyos sa di pagtupad sa nakasaad sa kontrata?

Thank you and sorry late reply Attorney. Inireview ko po ung contract and terms and conditions at sa tingin ko ang vague ng nakalagay. Eto ung ibang content:


"Should a trainee resign... any time after the training... But before the 1 year period has lapsed, the trainee will reimburse the bank the entire amount ---, due and demandable upon filling of resignation. If not paid on the date, same shall bear an interest..."

"You agree to abide by the established working hours for the position which you are hired. On account of the nature of your position/ functions, your work schedule is flexible. You, thus agree to accept and comply with whatever work schedule/ shifts that may give you from time to time. Moreover, you shall not perform any overtime work on weekdays, sunday or legal holiday, unless specifically directed by duly designated officers."

"While under the employ..., you shall not file any case against ... Your violation of this condition shall be considered as an act against ---'s interest and shall constitute a ground for termination."

Attorney pag nireport ko ba sila maiinform sila? Me gagawin ba silang aksyon? 6 months na kami pero wala pa din kaming HMO, me nilabag ba sila dun?
