Hi! If the work environment, colleagues and Sup causes an employee stress, anxiety and depression, can this employee elect to file for immediate resignation?

Per the company employee handbook
The management will never recuse a resignation but may and in IGT's case will require you to render 30 days.

If the employee will not render, it will be tagged as AWOL per the HR. Your status will terminated.

Please advise. Thanks

Hi

Question about immediate resignation too. We are a start up company here in Manila. Since we are new, we want to make sure that we take care of our clients. We hired this long time friend because he said he really needs a job, even if he did not have the enough experience, we trained him and gave him one of our clients. We gave him the employment contract, the company has already signed it. He has to sign it and have it notarized and he should return it to us. Before he could do that, he went to the office and just said that he will no longer work and he is resigning effective that same day. NO letter. No notice of any sort. A clause in the contract says that an employee should render 30 days for us to inform the client, find and train a replacement which in this case did not happen. The client got mad, no longer spoke to us, no longer answering messages and did not pay us a single cent. This former employee keeps on sending us message that he wants his salary (1 week - the client trained him). And he keeps on sending message that he is planning to bring it up to Labour.

Question - is the contract binding even if he did not sign and return it to us? The client we lost is a big client and we have spent company funds to be able to get that client to say yes.

Will the employee have a strong case?

Really really really need a clarification.

Thanks

If you have proof that he actually worked with you, then yes there may be an implied contract and you might be entitled to file for damages against the employee.

Hi po. Ask lang if uneven workload may be a reason for immediate resignation? Sa case ko po kasi we started with 7 members sa team, but now 3 na lang kme including team leader. So lumalabas po na 2 na lang ung nagawa sa team. But im doing lets say 70% or more ng workload sa team and wlang gnagawa ang company pra mabago yun. Pwede po bang maging reason ko un for immediate resignation?
