Hi. I am currently in a dilemma. I just filed my resignation in my company on the 1st of July. Our cut-off is from 25-10. Our company allows even only a few days of render and I rendered service only until the 10th. So I am rendering service from July 1 to 10. I was informed by the hr head that I would not be paid any wage of my days from July 1 to 10 since the cut off was on the 25th and I filed resignation after cut-off. Is it legal for them not to pay my working days from 1-10? It's not even going to be included on my backpay. It will be considered as free rendered service. Hope you can help me.

The work from 1-10 may be held, but should be paid out as part of your final pay.

If it won't be paid out then you should not be required to work during those days any more.

Bottom line is that employees should be paid for days worked.

That's in the Labor Code.
