Hello po, ganun din po ang problema ko. Kagaya po niya. Ang kaso po yung dating kong kaibigan na sinisiraan ako pinabarangay ko na. Tapos po pinagpipilitan nyang wala siyang naging utang saakin. Parang ako pa po itong napahiya,wala daw ho kasing kasulatan na nagkautang ho siya saakin 25k po ang utang niya at dinedeny to death nya po ito. Ano po kaya ang magagawa ko sir?

LIBEL

Sa ilalim ng Artikulo 353 ng Binagong Kodigo Penal ng Pilipinas, ang libelo ay isang pampublikong at malisyosong bintang ng isang krimen, tunay o haka-haka, o anumang pagkilos, pagkukulang, kalagayan, katayuan o kalagayan na ang hangarin ay siraan o maging sanhi ng kasiraang-puri o paghamak ng isang tao. Kaya, ang mga elemento ng libelo ay ang:

1. pagbibintang ng isang kahiya-hiya gawa o kalagayan sa iba.
2. paglalathala ng mga bintang.
3. pagkakakilanlan ng taong defamed.
4. ang pagkakaroon ng masamang hangarin.

Sino-sino ang pwedeng kasuhan ng libelo:

Ang sinumang tao na mag published, eksibit, o maging sanhi ng mga eksibisyon ng anumang paninira sa pamamagitan ng sulat o o kahalintulad ng ibig sabihin nito ay magiging responsable . Ang may-akda o editor ng isang libro o pamplet, o mga editor o may ari ng isang pang-araw araw na pahayagan magasin, o publikasyon, ay magiging responsable para sa defamations nakapaloob kung siya ay ang mga may-akda nito.

ANG SLANDER AY PANINIRANG PURI SA SALITA O KILOS NA WALANG KATOTOHANAN NA NAKAKASIRA SA REPUTASYON AT KARAKTER NG ISANG TAO NA MAY PARUSANG KULONG UNDER ARTICLE 358 NG REVISED PENAL CODE. ANG SLANDER AY MAY DALAWANG KLASE, SIMPLE SLANDER NA MAY MABABANG PARUSA AT GRAVE SLANDER NA MAY MATAAS NA PARUSA.

Grave Slander at Salnder by Deed. Ang "Slander" o "Oral Defamation ay isang sinungaling o walang katotohanan na paninira na ipinahayag mula sa salita o kilos na nakakasira sa isang reputasyon o karakter ng isang tao. Ito ay pinaparusahan ng kulong at isang krimen under Article 358 ng Revised Penal Code:

ART. 358. Slander. - Oral defamation shall be punished by arresto mayor (1 month and 1 day to 6 months) in its maximum period to pricion correctional (6 months and 1 day to 6 years) in its minimum period if it is of a serious and insulting nature; otherwise, the penalty shall be arresto menor (1 day to 30 days) or a fine not exceeding 200 pesos.”

Ang krimen na Slander ay may dalawang klase, ang Simple Slander na may mababang parusa dahil ito ay isang light felony lamang at Grave Slander na may mataas na parusa. Ayon sa Supreme Court case na Villanueva v. People [521 Phil. 191 (2006)]., oral defamation or slander is the speaking of base and defamatory words which tend to prejudice another in his reputation, office, trade, business or means of livelihood. It is grave slander when it is of a serious and insulting nature.

to be able to file a case against your debtor under the Rule of Procedure for Small Claims Cases, the money claim should not exceed P100,000, which should already include interests and penalty fees (if there’s any). If the money being claimed is more than that amount, then the plaintiff would have to go to regular court.

Here are the basic steps in filing for a Small Claims Case in the Philippines:

1.Go to either one of these places to file your case:
1.First level court of the city where you live
2.First level court of the city where your debtor (defendant) lives

2.First level courts are defined as any of the following:
1.Metropolitan Trial Court
2.Municipal Trial Courts in Cities
3.Municipal Trial Court
4.Municipal Circuit Trial Courts

3.Go to the Office of the Clerk of Court and fill up the following forms:
1.Information for Plaintiff
2.Statement of Claim
3.Certification of Non-Forum Shopping

4.As plaintiff, you would also need to accomplish a Verified Statement of Claim which certifies that all information you gave is correct and you have not filed the same case in any other court.


5.You would also need to provide other important documents that will show sufficient proof that the loan occurred, this can be ANY of the following:
1.Signed contracts by the defendants
2.Promissory notes, receipts, bank deposit slips, checks and other “paper trails”
3.Latest demand letter with proof of delivery and proof of receipt
4.Affidavits of witnesses

6.After this, the plaintiff will then have to pay a small amount to file the case. According to a lawyer friend, this is usually around P1,250.00.


What happens next?

Now that all the documents are submitted, and all administrative fees are paid, the court will then assign the case to a judge (through a raffle) and if it’s found that there is merit to the case, the defendants will be given a Summon, Notice of Hearing, Information for the Defendant, Response Form and other documents.

Then, the plaintiff will be informed and will be sent a Notice of Hearing which will state the scheduled


Nasa Sec. 20, Art. III ng 1987 Constitution that "no person shall be imprisoned for non-payment of debt."
