Good day. I have a child born out of wedlock pero dala yung surname ng father nya who has been very irresponsible since then. I am married now, and my husband and I wanted her na iadopt yung kid ko so she would also bear my husband's surname. We talked to the father and told him about our plans. We are just saving money paara sa adoption. Would that cost a lot? How long will it take? The problem now is, yung biological father seems to be interested sa anak ko. He said he wanted to make up with her, while all throughout the years he had never been a father. Not financially, morally, spiritually. I want to ask what rights does he have as a father? As a mom, I wish not to associate my child with him anymore. He had been neglecting him for so long, why act like a father now. Could there be anything I could do or we could do para huwag na gumulo yung sitwasyon? My kid has better environment now. He has a dad to call daddy in every sense, someone she can show her love and care and she'd feel the same. We want to adopt her as soonest possible time. My husband is working outside the country. What would be the best solution for my sentiments. Please help.

the father, since his name and surname appears in the child BC, so u need his consent before ur hubby can adopt her.

u can convince the father, that adoption is best for the baby,,

Thanks for the info and replies..how long does it take? (Whole process of adoption) in case the biological father change his mind, any other legal option we can do?

yung iba kasi.. ang ginagawa is ipna pa register late na lng ang bc ng bata and abandon the original at ipgamit ang new surname sa new bc nito.

Ang pagrerehistro ng birth o kapanganakan ng bata o sanggol sa pangalan ng isang babae o sa isang tao na hindi niya totoong magulang ay hindi legal na adoption o legal na pag-aampon. Ito ay walang bisa at epekto sa batas at ang gumawa nito ay pwedeng parusahan gawa ng ito ay isang criminal offense under Article 347, Revised Penal Code na tinatawag na "simulation of birth." Ito rin ay pinaparusahan under R.A. 8552 otherwise known as Domestic Adoption Act of 1998. Ang sinumang gumawa nito ay pinaparusahan ng pagkakakulong ng prision mayor (6-12 years) in its medium period and a fine not exceeding Fifty thousand pesos (P50,000.00).

reminder lang yan teh ha.. yung iba kasi sa sobrang desperate madala ng new husband nila ang apelyido ng anak sa unang asawa ng babae eh ganun ang ginagawa Smile yung ipapa register late ang bc at ipapa acknolege sa new hubby kahit hndi naman ito ang tunay na ama.

Ang legal na adoption o legal na pag-aampon ay nagsisimula sa pagsasampa ng petition sa korte at pagkakaroon ng Child Study Report ng DSWD or court appointed social worker upang alamin na makakaganda sa kapakanan ng inaampon ang adoption. Pagkatapos nito ay iuutos ng korte ang publication ng petition for three (3) consecutive weeks a newspaper of general circulation at itatakda ang presentasyon ng ebidensya ng nag-aampon. Patutunayan sa korte na meron siya kakayahang physical, financial at moral na palakihin ng maayos ang bata at hindi siya disqualified na mag-ampon. Bukod dito at kailangan rin ipakita sa korte na pumayag ang nanay at tatay ng bata sa pag-ampon. Pagkatapos nito ay uutusan ng korte ang OSG o fiscal na magpresenta ng evidence kung tutol sila sa adoption at pagkatapos nito ay maglalabas ng decision ang korte. Kung pabor sa nag-aampon ang decision ng korte at ito ay naging final and executory, ang decision ay irerehistro sa local civil registrar kung saan nakarehistro ang birth certificate ng bata upang baguhin ang kanyang apelyido. Kung kaya, ang pag-aampon ay hindi basta-basta at dapat idaan sa tamang proseso ng batas.

and if im not mistaken. same rule will be apply even ikaw ang totoong mudrabels ng junakids mo:)

Numero uno ng eepal ang biological father. I am aware dun sa simulation, I have known some who did it pero mas mainam na dumaan sa legal na proseso. Yun nga lang malaki ring halaga ang gugulin.


Other than adoption there won't be any action I/we could make?

pero, need rin eto ng legal,,
at magastos rin to,,

do not resort to late registration,,
many are now facing the consequences of that flaw..

Adoption is their only solution.

You need to secure consent from the biological father. However, in the case of Cang vs. Court of Appeals (GR No. 105308, September 25, 1998), the Supreme Court of the Philippines held that the requirement of written consent can be dispensed with if the parent, whose consent cannot be obtained, has abandoned the child or is “insane or hopelessly intemperate.” In this case, the court may still acquire jurisdiction over the adoption case as long as the petition alleges facts sufficient to warrant exemption from the requirement.
