Na-award po sa mga magulang ng misis ko ang lot property from NHA noong 1995. Lima po silang magkakapatid.
Nakapangalan po sa magulang nila yung Titulo.
Sumakabilang-buhay na po ang ina nila.
Since may kanya-kanya na po silang pamilya magkakapatid,
Nag-decice po silang ibenta yung property.
May Buyer na po kami, kaso eto po ang problema.
Paano po maibebenta kung may clause na
"Restrict to Sell" yung TCT?
Saka hinahanapan po kami ng blueprint ng Buyer, wala naman po kaming nun. Required po ba iyon sa bilihan ng property?
May TCT naman po kami. Kailangan po bang orig ang TCT or pwede na po sa bentahan ang Certified True Copy ng TCT from government?

1. Merong restrict to Sell- kasi nga galing sa government yan, at di bilang beneciary tayo, di dapat at di pwedeng ibenta...

2. Ang original n copy eh nasa Government,
all transactions with "Restrict to Sell" are legally void,

Seller acted on bad faith...

Salamat po.
Young father-in-law ko po kasi ang nais magbenta ng property.
Naaalala po kasi niya ang mother-in-law ko habang nakatira siya dun.
Sila naman pong magkakapatid ay may kani-kanya nang pamilya.
Welcome naman pong tumira sa amin ang father-in-law ko kapag nabenta na yung lupa.
Although na-award yung lot, hinulugan pa rin ng byenan ko hanggang binigyan sila ng TCT ng NHA.
May paraan po ba para matanggal yung "Restriction to Sell" clause sa TCT?

kapag natapos hulugan yong lupa, then bibigyan kayo ng NHA, ng ORig TCT..
Deed of Absolute Sale. pero parang meron pang additional years bago pwede ibenta.
para kasing though hinuhulugan, bigay pa rin ng gov't since medyo mababa ang terms, compared sa Realstate developers.

1985 pa po nabayaran ng buo (PHp68k+) yung lupa. May TCT na po, pero nasa TCT nga po yug clause na "restrict to sell."

You might have to file a petition for the removal of the annotation or condition in court before you are allowed to sell.

How many years is the restriction?
