Child support need an advice..

need ko lang po ng opinion about my case..i have filed a ra9262 case against my husband last 2008 pero ngkasundo ho kami now na ipadissmiss na yung case.ang habol ko na lang po kasi is yung financial support para sa dalawa naming anak..hindi daw kasi cya mkapagapply since hindi cya mkapagrenew ng nbi clearance nya kaya din wala cya maibigay na support sa mga bata.pano po ba ang gagawin ko para madissmiss yung case at masigurado ko na susuportahan nya nga yung mga bata?salamat po..

what is the status of the case now, is it in court or still at the prosecutor's office? if at the court, talk to the prosecutor how you can have the case dismissed. he might ask you to issue an affidavit of desistance and affirm it before the judge.

i'm not sure how you can get a written agreement of support. vawc cases are not allowed to be compromised. nevertheless, you can still enter into an agreement with your husband and have it notarized. note that his failure to comply will not result in revival of the case.

Bale po kasi ang nangyari nung ifinile ko yung case hindi nako ngfollow up since lumipat nako ng tirahan at wala nako balak.Yung naissue naman yung subpoena hindi narecieved ng asawa ko kc naassigned cya sa ibang lugar kya hindi nya daw narecieved.Then nung nag usap na kmi,cnabi nung husband ko na may outstanding warrant daw cya nung pinacheck nya sa friend nya,kaya ngayon medyo nagtatago cya pro may communication pa din kmi at sabi nya nga gusto nya na maayos at mkapgapply na ng work.
Ask ko din po kung pwede ko ilagay sa affidavit of desistance na kya ko inuurong yung case kasi nangako cya magbibigay ng support sa mga anak namin.Tanong ko din po kasi medyo malayo ho kasi yung napagfilean na hall of justice sa lugar ko ngayon,pwede ho ba isang beses lang pumunta since may trabaho po ako at sa ngayon yun lang inaasahan namin mag iina?at wala po ko masyado pangtustos sa pamasahe sa pagpapabalik balik sa lugar na yun.

the case will not be dismissed by your mere filing of an affidavit of desistance. unless your husband files bail, the case will be merely archived and the warrant will remain outstanding.

the better way is for your husband to file bail and for your to file your desistance. again, talk to the prosecutor, but i doubt if this can be done in just one day. good luck

last question po..pwde po ba yung pinsan nya yung magbayad ng bail nya at hindi sya personally,may takot po kasi cya na baka maarrest at makulong cya plus nasa mindanao sya ngayon?

no, he has to personally appear and sign documents to file bail.
