Here's my incident report. I am willing to take the risk of losing my job and i want to file a case against my boss. i would like to know if i will win this case or if there's a chance and what would be the arrangement that i will get to the company?

I would like to bring this up to your attention.

I would like to report an incident Last Monday, January 12, 2015 at around 1PM. Apparently,  my immediate Manager called me over my cellphone and asking for my productivity. I answered him honestly, and reported my productivity for last week which is 141. Then, he shouted at me and said “Bakit 141 lang, anong ginawa mo?” PUTANGINA NAMAN! Anong ginawa mo maghapon?... Kung ganyan lang din ang ginagawa mo, tanggalin ka nalang diyan. (Why it is only 141? MOTHER FUCKER! What did you do the whole day)” I was shocked and told him “Boss baka pwede naman pagusapn in a professional way… (Boss, can we speak in a professional way...)” that it would be better if he do not curse, and if he can speak quietly and softly. To my despair I even asked him “Boss wag naman po kayo nagmumura… (Boss please refrain cursing...)”. He cursed not just once as far as I remember. End of call.

I am disappointed with the attitude of my superior. It is very unbecoming and very unprofessional. I know he was disappointed with my numbers, but it is not a reason for him to curse, and he even threaten my job. From the time of the incident, I can’t sleep well, His words still lingers on my thoughts, I can still hear him shouting and cursing, and that makes me feel unwell that I need to go to the doctor for consultation. I feel so down and degraded.

To have a little background, it was unclear to me, and there was no mandate or whatever formal written information that I need to produce a ‘number’ as a productivity for the new account. I did not sign up for any commitment stating that I need to produce a certain number.

I stayed professional as I can, and my manager should not do cursing either direct or indirect to me. This not only happened once, and for me twice is too much. I don’t want to have another instance of me having a conversation with him for he has unprofessional attitude over the workplace. I don’t want this to happen to me or to anyone. I even heard that there was an instance like this. I don’t believe until it happened to me. This is not the Manager that I would like to work with.

As per policy the Employment Policy, it stated that “It is expected that conversations between employees and customers and among employees themselves will always be in a professional level and that the volume of such conversations will be a low level. Loud, boisterous conduct and actions are discouraged.”

It is also mentioned on office protocol and decorum that “uttering obscene, insulting or offensive words, or making discriminatory remarks against any employee, client, customer, or visitors within a company” is not allowed. I know it is not directed to me, but the way he utter words are unacceptable. Also, “threatening, intimidating, coercing clients, customers, visitors and other employees” should be avoided. In this way he threaten my job, I don’t have a job security, thinking that this might create a grudge in between us.


Should you asked for additional evidence like our phone conversation, I am willing to provide it.

That is the actual incident report that i forwarded to our HR department and probably they will just arrange the relationship between us. Besides i really what to file a case probably with DOLE.

Next question is if you can win or if it's worth the effort.

Most likely DOLE will refer this back to your company.

What do you want DOLE to do for you? The following can be handled by DOLE/NLRC:

Non-payment/underpayment
of:

3.  Night-Shift Differential Pay
4.  Service incentive leave
5.  Holiday pay
6.  SSS
7.  Philhealth
8.  PAG-IBIG

b) Unfair Labor Practice (ULP)
c)  Illegal Dismissal
d) Illegal Dismissal with Money Claims

Hi,

I have a friend who has a problem with her current supervisor. She felt that she was threatened to lose her job from what her sup told her. According to her she was given 4 citations all in one day for tardiness and attendance. This is for written and final warning. She was not given 5 days for explanation for the first instance before the final warning was issued. The manager even told her "maghanap ka na ng trabaho kce pinagiinitan ka na ni ____" (stating name of the Operations manager)

can this be considered as harassment or intimidation?

She also found out that HR does not know the Internal goal Agreement given to her by her sup for her new post as tech. What can she do about it? She already talked to HR and complained however she wants to know what she can file if she went to DOLE.
