Good day everyone... Hingi lang po ako ng advice kung anong magandang gawin para mailipat sa amin ung title ng bahay namin. Meju complicated po kasi ung case. Sa tatay ko po galing ung pinambayad sa bahay namin nung binili nila Lolo ko. Nakaabroad po tatay at nanay ko nun, halos bagong kasal lang po sila nung binili
po ung property. Kila Lolo ko po ipinangalan ung titulo. Hindi na po naasikaso ung maayos na paglipat ng titulo sa tatay ko hanggang sa sumakabilang buhay na po siya. Pero meron pong deed of donation nung property na tatay ko po ung donee. Ano po magandang gawin para mailipat po sa nanay ko o kaya sa amin ng kuya ko ung title ng property?

Palagay ko you need to execute a Deed of extra-judicial settlement of the estate among his heirs including your mother. Tanong ko lang, nabayaran ba ang donor's tax sa BIR nuong ginawa ng lolo mo ang deed of donation sa tatay mo as donee? If not, then you will face a problem in paying the donor's tax as it has penalty if not paid within 60 days from date of notarization. Take heed in the wordings of the deed of extra judicial settlement as it may involve both donation and estate tax payments to BIR not mentioning the transfer tax payments to the municipal treasurer and registration fee in Registry of Deeds in titling it. The deed as per Rule 74 of the Rules of Court requires the publication of the deed for 3 weeks in a newspaper.

Note: I am not a lawyer, but just an ordinary personal sharing my opinion and experience that maybe helpful in your problem.
