Good afternoon. I just recently learned that my partner was married. I was so sad, hindi ko alam kng ano gagawin. Paano ba naman kakapanganak ko lng sa anak namin. Now he promised my parents and me na he will file an annulment this December, kc he is working overseas.

What im concerned about is, lets say the annulment was successful, according to a friend na even if we will get married legaly kc nga annulled na cla, all the investments, the properties that we will be purchasing will still go to the first legal wife? Is that true? If that's the case, I will not continue this relationship.. Wala parin po akng security if this is true. I know our child will be secured but not me. Kc pano if xa una mawala, his children will have rights with everything, kng kelan matanda na ako saka pa mawalan nang savings o bahay.

yung existing nilang properties hahatiin pag nagrant ang annulment. pag kinasal ka na sa kanya, kung ano man ang maipundar nyo during the time of your marriage e wala nang pakialam ang dating asawa.pero dapat ata bago mo problemahin yan e unahin muna nya ang pagpapa annull. kasi pwede kayong kasuhan ng asawa nya sa sitwasyon nyo ngayon.

Yes po. aasikasuhin nga yan nang partner ko, by december. pareho kc cla abroad. actually ho ok po naman ang relation nang lahat. besides sa loob po nang 10 years nilang pghiwalay, may naging iba't ibang partner silang dalawa. so before i came into my partners life, parang may kasundoan na cla. eh ayaw ko na ganun lng, na maging kabit... in fact nga ho, kng hindi lng sana ako naging matigas ang ulo, hindi sana ako mapasok sa ganitong sitwasyon. may anak na kc kami kaya i can't leave him. cguro pag pwede na maiwan anak namin.
anyway ho, pwede ba mka file nang anulment if both parties are abroad? or just one of them is here in the philippines?

Yes, pwede po magfile ng annulment even though both are living abroad. However, pagfile nun, may mga kailangan pirmahan ang partner mo.

If I may ask, Filipino citizens pa ba ang partner mo at ang first wife niya?

Yes po.. both of them are still filipino citizen. ang partner ko lng ho ang madaling mka uwi. seaman ho kc xa. so pwede xa mg file? kahit wala dito asawa nya?

Ok po. Yes, pwede po siya magfile kahit wala dito sa Philippines ang asawa niya. Pero kailangan alam niya ang address ng asawa niya kasi kailangan yun pagfile ng annulment.

Also, since seaman ang partner mo, kailangan i-prepare na lahat ng documents na kailangan sa pagfile ng annulment para pagbaba niya sa barko, ready na lahat ng pipirmahan niya at mafile agad.

What are the papers that my partner needs to prepare?

I have another question ho. Tungkol po ito sa housing loan nang pag ibig o bank. this is what happened, we had purchased a property last february this year. I was given an SPA by my partner to take care of BIR as well as transfer of title into his name. When I was in ROD last time, I was asked to place the name of his wife sa Deed of Sale, kc married lng ang nkalagay. Gusto ho nang partner ko gawin lng single ang status nya.. pwede ho ba yun? e legal documents yan, dba malalalaman dn yan nang legal wife.

Gusto ho nang partner ko, e process and TCT after sa anulment.. pwede ho ba yun? e nakasaad na don sa BIR na nabili namin ang property last february.


And hindi rin namin na concider na elagay sa name ko..so talagang sa name nya..


What can you all say about this?

ABout sa pag ibig and bank housing loan, if we will use this title with the name of the legal wife, dba she needs to affix her signature sa loan?
