hi. good day! i need your advice. last june 2014 i filed an estafa case but after 4 months i received a letter that it is not appropriate for a civil case but i havent gone trough preliminary investigations yet. last april 2014 i made a transaction that items will be delivered to me the next day after giving my full payment the day before but no items where delivered so we made an agreement to pay me back asap but she has not fulfilled this agreement so i decided to file against her. is it legal to dismiss a case even without preliminary investigation? the police whom i filed said i have a strong case since i have the evidences and witness. how come after 4months i just received a letter it was dismiss. what actions should i do?
by the way i have a friend who also filed the same thing to her and she is now waiting for her warrant. how come?
