Hi Atty.

I need your advice. I had a credit card, unfortunately i became delinquent payer for this pass 5 months. Last Wednesday, i received a call from a camp crame daw po cla. Dadamputin na daw nila aq kapag hindi aq nakipag-ugnayan sa ngfile na case against me. Tumawag po sa iniwang no. at hanapin ko daw po c Atty.___. Tumawag po ako immediately, tpos sbi po ng atty. na nakausap q ibababa na daw po ung warrant of arrest sa akin kasi hindi daw po aq umaatend ng court hearing. Wala po ako narereceive na letter from court to attend hearing. Sa takot ko po, kinausap ko po ng maayos ung Atty. at napag agreehan po namin na mgbayad daw po ako ng initial payment na 20K sa Oct. 29 para daw po hindi matuloy ung pagdampot sa akin ng police. Kung hindi po ba ako makakapag bayad sa nasabing date. Makukulong po ba ako? natatakot po ako, kasi po ayokong makulong. Mahihirapan po kasi akong magproduce ng 20k agad. Wala po ako ganun kalaking halaga ng pera. Yung utang ko poh ay umabot na sa 76k dahil po palagi nalang me nagbabayad lang ng minimum. Pls. help naman po.

what you should avoid is changing office or residential address without informing the credit card company. failure to do so raises the presumption of fraud and they can initiate a criminal case against you.

you may however, change your telephone number to stop these people from contacting you.

this is nothing new in the forum. these callers are not cops, just collectors pretending to be one, or worse, actual cops moonlighting. these threats are just meant to coerce you to pay. i find these tactics foul.

get the name, rank and office of the caller and verify if they are really police.

search the name of this supposed atty on the net (si alf na naman ba ito? don't post the full name) and see if the name appears on the roll of attorneys.

nevertheless, you still have the obligation to pay. as is the experience of other posters here, after all the scare tactics, they will file a small claims case against you. it is a civil case for collection, not criminal.

failure to pay a debt is not a crime.

Hi Atty.,

Nagcheck na po ako sa sc.judiciary.gov.ph ng name ni atty. na kumakausap sa akin sa phone, kaso po hindi ko po makita ung name nya sa list of lawyer.

Atty. alam nyo po ba, meron pinagawang promissory note sa akin c atty. xxxx, ung lahat po ng nakalagay sa note ay dictated po nya sa akin. ngyon po iyon po yung pinanghahawakan nyang doc. na panlaban sa akin para daw po damputin ako ng CIDG kapag hindi ako ngcomply sa agreement sa promissory note. Ito po ung nakasaad sa promissory note.

Page 1. " To: Atty. XXXX, legal defendant of Bankers Association of the Phil. From: Complete name ko po, address, at years ng home stay ko sa nasabing add." the letter say " I promise i will pay my obligation w/ (bank name) amounting of Php. 76,208.17. I will issue initial payment of Php. 20,000.00 on Oct. 29, 2010 in cash at (Bank Name). The remaining balance of Php. 56,208.17 will be payable in 6 months starting Nov. 2010-Apr. 2011, every end of the month of banking day. My (bank name) acct. no. ####-####-####-####.
If i failed to comply on the 1st initial payment on Oct. 29,2010. The warrant of arrest will be serve as soon as possible.

Page 2.
Photocopy of 2 valid ID. and 3 signature ko.


Atty. hindi po ako nakapag comply sa initial payment kasi po yung inaasahan ko pong perang dadating ay nadelay. Nagpapaliwanag po ako ng husto kay Atty. X, kaso po ayaw nya ako pakinggan nung una, pinipilit po nya akong magbigay ng 20,000 kahapon kahit wla po ako tlga mahiraman ng pera ng ganun ganun lang. Tpos sbi po sa akin kung hindi ko daw po mabibigay yung 20,000 magpadamput na daw po ako sa CIDG. kasi po binigyan na daw po nya ng go signal na hulihin ako sa pinapasukan kong company. Pilit po akong nakiki-usap kay atty. x na pakinggan naman po yung side ko, tpos nagbigay xa ng option kung mgpapa LBC daw poh ako ng PDC amounting of 20,000 kahapon eh papa stop daw nya yung pagdamput sa akin. sbi ko wla po ako PDC kaya impossible po kako na maibigay ko iyon. Sbi po eh di magpadamput ka nalang at maghanap ka ng atty. mo kaso ngyon nakaholiday na mga public atty. kaya matulog ka nalng muna sa kulungan hanggang meron kanang atty. pang bail. Takot na takot po ako kahapon, hindi na nga po ako nakapagwork ng maayos kahapon eh kakaisip ng paraan para lang meron akng maipasok na 20,000. kaso wla din pong naipahiram sa akin mga officemate ko. ngtx po ako kay atty. x cnbi ko po na sana maintindihan nila ako, at hindi ko tlga maibibigay yung 20,000 ng Oct. 29 kahapon po. tumawag po ulit c atty. x sa akin at cnbi po nya cge pagbibigyan kita kaso dapat umaga ng nov. 2 nakapag initial kana ng 20,000 kung hindi wag kana pumasok jan sa office nyo dahil mapapahiya ka lang dahil yan kapa dadamputin ng CIDG. mgstay ka nalang sa haouse nyo para sumama ka nalang ng maayos.

Atty. natatakot po ako until now. Tlga po bang makukulong na ako dahil sa promissory note na pinagawa sa akin? sbi sa mga nabasa ko sa ibang post d2 wla daw nakukulong dahil lang sa utang pero bakit po ako parang tiyak na makukulong?

Pls. help me naman po, I need your advice.

Thank you so much po. Buhat po kasi ng makareceived ako ng phone call from atty X, eh hindi na ako makatulog ng maayos at hindi narin po ako makakain ng maayos kasi po isip po ako ng isip na baka bigla nalang po ako damputin ng mga CIDG at para na nga po akong praning kasi po konting ring ng phone sa office, kinakabahan po ako na baka ung CIDG na yun, pati po sa bahay kapag po nakakarinig po ako ng humihintong sasakyan ganun din po naiisip ko agad.

Makakahinga na po ako ng maayos. Pero xempre po dapat ko parin gawan ng paraan yung mga utang ko sa credit card ng saganon, luminis na po name ko.

shanmei, no. failure to pay a credit card, without fraudulent intent, is not a crime.

emjay, good luck. to make a settlement, contact the bank directly, not this so-called atty. offer as big an amount you can now then monthly payments for the rest. note there is a case decided by the supreme court that the 3.5% monthly interest is unconscionable and was reduced to 2% per month inclusive of penalty.
