yes. a non compete clause in a contract of employment is generally valid and enforceable.

the best evidence is the contract itself. as long as it is proven that your signature in that contract is genuine and the non compete clause has reasonable limitations as to time, trade and place, you could be held liable.
it's best to talk to your employer first and find a win-win situation. a compromise to pay just half of the penalty will not be bad.

they can sue you but any allegation requires proof. the burden is on them to prove that youre really on the same industry. no evidence, no liability.

kung may court order, pwede. kung wala, hindi pwede unless yun bagay na tinutukoy mo ay nakasangla o subject of a chattel mortgage.
