Nabasa ko po 'yung part ng Labor Code natin (Book III, Title I, Chapter III, Article 95) that talks about SIL (service incentive leaves). Nalilito po ako sa part where it says na hindi naga-apply ang provision to "those enjoying vacation leave with pay of at least five days". Paano po ba siya nagwo-work?
Sa company po kasi na pinagta-trabahuhan ko ngayon, we are given a total of 11 VLs and 10 SLs per year. Binibigay po ito not on a yearly basis but on a monthly one. So bali po, every month may natatanggap lang ang isang regular employee na 0.92 na VL (11 VLs / 12 months) at 0.83 na SL (10 SLs / 12 months). Eto lang po ang policy namin regarding sa leaves namin: 1) if hindi mo maubos ang VL or SL mo within the same year, make-carry over siya for the next year; 2) if after 2 years at hindi mo parin nagagamit, mafo-forfeit na ang unused VLs and SLs mo.
Eto po 'yung mga questions ko regarding the statements above:
1. Legal po ba 'yung ginagawa ng company namin na every month lang nae-earn 'yung portion ng SL at VL?
2. Dahil po ba meron kaming more that 5 combined SLs and VLs, hindi na kami legible for SIL?
3. Kung hindi na po kami legible for SIL, ibig po ba sabihin nun, hindi convertible to cash if ever may matira kaming VL or SL kung walang nakalagay sa company policy namin?
