Arresto Menor

Hi... Can the head of a department (only) be terminated? They gave a memorandum stating 'REDUNDANCY'.

Plus, after that notice, he got so stressed and ended up had a mild stroke.

What should we do? Please advise.

Yes. Redundant meaning sobra ang headcount - at least 2 silang gumagawa ng parehong trabaho.

We really felt that what this company did is in bad faith. They taken him out and putted a new (foreign guy) to head the department. Can we check the legality and if ever file a case?

Company has the right to assign people to any position they see fit. As long as the redundancy procedure is correct then nothing can be done. You cannot file any complaint as you are a third party with not interest in the situation.
