Holiday Pay Not Paid

Good Morning to all HR Practitioners here.

Employee po ako na binabayaran on a monthly basis, bayad po mga holidays ko and rest days.

Eto po yung tanong ko, last year po kasi, nag - absent ako ng December 29, 2013. then nakita ko sa payslip ko na hindi nila binayaran yung proceeding holidays (Dec 30, 31, January 1) dahil hindi raw ako pumasok noong December 29, 2013 and na - exhaust ko na raw lahat ng paid leaves ko.

Totoo na na exhaust ko na yung paid leaves ko pero nag contest pa rin ako na regardless kahit na naubos ko na yung paid leaves ko dapat bayad pa rin ako sa holidays dahil paid ako on a monthly basis.

tama po ba na hindi ako bayaran ng holiday pay? for now kasi nag stop muna ako i - contest yung decision ng HR namin.

According to the implementing rules of the labor code:

SECTION 6. Absences. — (a) All covered employees shall be entitled to the benefit provided herein when they are on leave of absence with pay. Employees who are on leave of absence without pay on the day immediately preceding a regular holiday may not be paid the required holiday pay if he has not worked on such regular holiday.

kahit pa monthly/daily basis ka, kapag di ka pumasok before holiday o nagfile ka ng leave pero wala ka ng available na credits, considered as no holiday pay ka sa mga susunod na holiday after ng huling regular working day.
