ESTAFA: Can my mother-in-law post bail in my absence?

Hello po sa inyo!May naissue pong warrant of arrest sa akin year 2009 pero nkawork na po ako abroad bago ito dumating. Estafa case po na originally 5 complainants po cla kaso nadismiss na po yung apat after they we settled with them year 2008 .Yung isa po kasi ay nasa abroad na nung nagsettlement kami kaya pending case cya at nkareceive nga ako ulit ng warrant year 2009. Willing po akong makipagsettle sa kanya kaso wala na po akong contact. Uuwi po kasi ako this year pero gusro ko po sanang maclear muna at hindi po ako makulong.Eto po yung mga tanong ko:
1. Ano po ang gagawin ko?
2. Kailangan pa ba akong magbail bago magsettlement?
3. Pwede po bang ang mother-in-law ko nlng file ng magbail para sa akin dahil andito pa po ako sa abroad?
4. Ang original po na amount ng bail ay 20,000 sa lima katao.Ngayong isa nlng cya, possible po bang mareduce ang bail?
5. Kailangan po bang same atty namin before lang ang lalapitan ko?

If maayos nya kasi yan, marerecall yung warrant and there will no longer be any need to post bail. Problem kasi if you post bail first before settlement, kailangan personal appearance for posting bail. Since you are abroad, I don't think this is an option right now.

So based on what you've posted, I think the best way is to coordinate things through your lawyer instead of your mother.

Settlement will depend on the parties involved. Kung madali lang naman kausap, mabilis matatapos yan.

Yes, you can use another lawyer to initiate settlement if wala na contact with the previous lawyer.

No, you don't have to wait for settlement to go back to PH, but of course, nandun ang risk of the arrest warrant being served kasi active sya ngayon.

Kaya nga po recommended that you get in touch with your previous lawyer or get a new lawyer so that he could get in touch with the complainants on your behalf. Mas maganda kasi you have someone knowledgeable assisting para documented lahat and may basis.
