public utility jeep accident, operator and driver's responsibility

hello im melvin from taguig, i just want to have any ideas bout our case which is car accident. my mother own a public utility jeep, and got rented for private excursion/trip last week of October 2013. during the trip, our vehicle get involve in an accident, our driver hits a motorcycle commuter causing his motorcycle, and the commuter itself to be heavily damaged. our jeep was impounded in the police precinct nearby the location of accident. the commuter's relatives agree to just negotiate to our driver for the compensation of hospitals bills, demanding Php60,000 for initial payment. but they still hold our jeepney as an assurance. and now asking for more. now my question, is that Legal? the impounded jeepney is our driver only source of money. and our source of money too, how can we pay them if they hold our source of income. also is the jeepney operator has the same burden as the driver in this kind of case? i wish you advise me for this situation. ill be happy too of you can state your advise base on law article. thank you very much and God Bless
