Good Evening Po,

Itatanong ko lang po yung problema ko sa aking previous employer, hindi ko po nabuo ang 2 years contract ko sa kanila. Bale po sinisingil ako ng BOND kabuuang 2 months worth of my salary. Makatwiran po bang ipatupad ang ganitong employment bond kung wala naman po akong naging Training, Travel o tumanggap ng signing bonus sa kanila?

Payag naman po ako magbayad at makipag-negosasyon sa management, kaya lang po pro-rate ang computation.

Legal po ba ang employment bond?

Yes. Bonds are legal.

Bonds are for the purpose of guarantee to the company who has given you a training to equip you with the necessary skills for your position. Should you fail to render the number of years stipulated by the company in order for them to return their investment on your training, you are required to pay the bond. But for the bond to be claimed, it should be filed by the company in court.

If you didn't undergo training, you are not required to pay the bond.

question: not all bonds right?

cash bond when you dont have this kind of training naman and investment of the company to you bawal.

bond na nakaabang lang in case meron. no clear purpose its just there and imposed.

atty. Hihingin ko po sana ang opinion nyo. Hindi po talalga pumayag ang aking dating employer na mai-pro rated po ang aking bond, sa makatwid po full 2 moths worth of my salary po ang babayaran ko. May chance po ba ako na manalo ako dito kung sakaling mag-fifile po ako ng kaso sa aking dating employer?

Update lang po mga sir. As per last na paguusap po namain ng aking former HR, hindi po sila pumapayag sa settlement ko na pro-rate na lang ang computation. Kung hindi po ako magbabayad, hindi ko po makukuha ang aking COE, Tax Certificate at clearance. Yung dapat po sanang last pay ko naka hold din po sa kanila at may utang pa ako. Ano po kaya ang nararapat kong gawin? may laban po ba ako kung ihahabla ko ang aking dating employer para makuha ko ang last pay ko at lalo na po Tax certificate?
