Is being a member of a Homeowner's Association mandatory even if I'm just a tenant?

Gusto ko lang po sanang isangguni sa inyo kung tama po ba yung ginagawa ng Homeowner's Association dito sa amin. Noon po kasing nakaraang Lunes, October 7, 2013, nagsimula pong mangharang ng mga palabas at papasok na sasakyan sa aming village yung member ng Pavilhai (Paradise Village Homeowner's Association). Ayon po kay Ms. Susan Bargo, officer po ng nasabing association, kelangan po may sticker lahat ng sasakyan para payagan po nilang pumasok. Naunawaan ko naman po yun dahil para po yun sa seguridad ng mga residents. Kaya tinanong ko po sya kung paano po ako makaka-avail ng sticker. Sabi po nya, kelangan ko daw pong magpa-member sa Pavilhai. Sabi ko naman po, tenant lang po ako, nangungupahan lang po pero kung yun po ang kailangan, pumayag na po ako magpa-member at magbayad ng monthly dues kung kinakailangan. Subalit nung tinanong po nya ako kung ilang taon na ako na nangungupahan sa village, sabi ko po 3 years, dahil yun po ang totoo. Tapos sabi po nya, kelangan ko daw bayaran yung buong 3 years na monthly dues ng isang member. Nagulat po ako. Nakiusap po ako ng maayos, sabi ko po, hindi ko po kakayanin yun at parang hindi po yata tama yun. Tapos, sabi po ni Ms. Susan Bargo, sige yung isang buong taon na lang, yung 2013, mula January hanggang ngayong buwan na ito. Pero sinabi ko po na bakit po ganun, samantalang ngayon lang po ako magpapa-member. Hindi po ba dapat, yung buwan lamang ngayon ang aking bayaran at yung mga susunod na buwan. Sabi po nya, hindi daw po ganun. Hindi daw po nila ako matatanggap na member ng Pavilhai kung di ko babayaran ang buing taon at kung hindi naman po ako magpapa-member, hindi ko daw po pwedeng ipasok ang sasakyan ko sa village kahit na nakatira ako dito. Nangungupahan lang po ako dahil wala akong pambili ng bahay, may sasakyan po akong ginagamit dahil issue po yun ng company na pinagtratrabahuan ko, single mother po ako, hindi ko po kayang bayaran ang hinihingi nila, sinabi ko po ito sa kanya pero nagmatigas po sya. Sabi po nya, sa labas ng village ako magparada dahil di nila ako papapasukin. Sabi pa nya, mandatory daw po ang magpa-member sa Pavilhai. Tama po ba sila? Iba po kasi yung nabasa ko. Akala ko po voluntary ang magpa-member. Tsaka willing naman po akong magpa-member pero hindi naman po siguro dapat bayaran ko yung buong taon na hindi pa po ako member. Dahil unang-una, hindi ko pa napakinabangan yung mga pribilehiyo ng pagiging miyembro nung mga panahong yun. Tsaka madami naman pong walang mga sticker at hindi po miyembro ng village namin pero hindi naman po naging ganito ang karanasan gaya ko. Minsan naisip ko, siguro dahil hindi po ako kasing-yaman nila. Ganunpaman, hindi naman po ako ganun kamangmang para hindi malaman na may mali po sa kanilang rules.

Sana po matulungan nyo ako dahil malaking abala po sa akin bilang residente po sa village namin ang kanilang ginagawa. Abogado po ang President ng Pavilhai kaya higit ko pong kailangan ang inyong payo or legal na opinyon sa usaping ito.

Salamat po at sana marami pa po kayong matulungan na tulad ko.

HLURB has jurisdiction over inter- and intra - Home Owner's Assn. disputes. You can visit their office.

Thank you po. What about yung sinisingil po nila pag magpapa-member, kelangan daw po buong year yung babayaran. Tama po ba yun?

Clarifying some points:

IRR of RA9904. Section 4.  Definition of Terms.
(f.)  Association Member refers to a homeowner who is a member of the association where the housing unit or lot is situated and those defined in the articles of association and by-laws of the association


Ang member po ay ang homeowner. Ikaw po ay magiging member in place of the owner kung mayroon kang "written authorization" fom the owner.

IRR of RA9904. Section 10. Qualifications of a Member.  – Every homeowner shall be qualified to be a member of the association.  

A lessee of a member under a contract with a term of at least one (1) year may qualify to be a member and shall have the rights of a member  upon procurement of a written consent/authorization from the owner of the lot/housing unit. Until the written consent or authorization is revoked in writing, the owner of the lot/housing unit is deemed to have waived  the rights of an association member except the right to inspect association books and records.

A lessee of a homeowner under a contract with a term of at least one (1) year may qualify to be a member and shall have the rights of a member  upon complying with the requirements of membership under the by-laws and the law.

kung mayroon naman kayong kasunduan ni member/homeowner tungkol sa association dues, na ikaw ang mag-provide for this, ikaw naman ngayon ang may utang kay member/homeowner.

IRR of RA9904. Section 9.  Membership. – Unless otherwise provided in the Contract to Sell, Deed of Sale, or other instruments of conveyance, or annotated in the title of the property, membership in the association is optional.

Ang intra association dispute po ay between the assn and its members, pero sa kaso po ninyo ay hindi kayo member, kaya posibleng regular civil courts ang may jurisdiction.
