Hold of Salary after Resignation

Greetings!

I was a clinical instructor in a Nursing School and just want to tender my complaint on my previous employer regarding my salary.. after my resignation last August 31, 2010, i submit all the requirements needed for the clearance of my salary before the deadline. Unfortunately, the President of the school refused signed my clearance for the reason that according to the policy of the institution if you file your resignation at the middle of the semester you can claimed your salary by the end of the semester which will be on October 2010.

Sir/Madam, can i ask for legal advice if i can sue them if they will not released my salary for now? or i will wait till October 2010.. If that so, where could i file my complaint? probably it will take how many days?

what if il wait till October 2010 and that time my employer does not recognized my salary/clearance... can i still file a complaint?

I have all the necessary documents to support my resignation, copy of the grades as well as the receiving copy of the clearance but it is not clearly stated on the receiving copy that they received my clearance...they just put receive signed by the HR...

Pls help me coz i was bothered now...

first, ask for a copy of this supposed policy.

if you really wish to pursue a case, your remedy is to file a money claim at the nlrc. good luck.
