I am a manager who has been placed under preventive suspension due to an alleged complaint from my subordinate for abuse of authority and harrassment. statements that I allegedly said were intentionally quoted differently and my superior (who's supposed to mediate) filed such case against me. given that basis is mere heresay for suspending me, can I possibly file a case against my superior, hr & the company for emotional, psychological and financial hardship if I wouldn't be terminated? I no longer have the intention of pursuing my employment with this company due to strained relationship. hope to hear back from you soonest. thanks!

Since you are merely on preventive suspension, wait it out. Prepare for your defense, you are still under investigation. Who knows, you might not be penalized if the management finds out that you are in the right.

thanks atty melki. however,to be honest I am more bothered on what will be my next step if in case I am proven not guilty. I know this might sound odd but given the circumstances I no longer have the intention to continue my employment with said company. all these happened simply because I am being managed out and I have ways to prove. these

being said, does it mean that the only option I have is to resign if I'll be asked to report back to work? thanks in advance for your advice.

The best thing to do is wait and prepare for your defense, I assume they are asking a written explanation from you. Preventive suspension only lasts 30 days. After that they have to reinstate you or continue suspension BUt pay your salary

If you are being managed out, gather the necessary evidence and witnesses to prove this. It may be grounds for constructive dismissal.

hi atty.

I have a meeting today with our hr for the result of their investigation. if in case i'd be asked to sign a document that says something I am not comfortable with, can I indi
cate "under protest" below my signature? I just fear that if I sign, i'd be bound with something which I don't agree with.
