Hello po Atty. i just want to ask legal advice po.. I was accused by my company for qualified theft.. I was the one po kasi handling pettycash in our office.. Admittley po "some of the cash" was used for my personal.. Ang iba naman po hndi ko na mahanap yung receipts for liquidation.. Some naman po hindi ko na din maaccount. So ngtotal po ng 100k+ unliquidated cash advances. Ngayon po, they are requiring me to undergo polygraphic test and pinaamin po nila ko.. I admit po to my boss that some of the cash i used for personal pero im very sure po na yung na-used ko for personal did not reached 100k.. So i told to my boss that due to mismanagement im willing to pay nalang the total unliquidated. My question po, since i promise to pay them, pwede parin po ba nila ko kasuhan ng qualified theft at ipakulong? Do i have the right to refuse to undergo polygrahic test? Im mentally affected na po sa mga ginagawa nila.. Pls advise po.. Thank you po in advance.. God bless..

the answer is yes, they can still charge you, but imo, it should not be qualified theft, but estafa through abuse of confidence.
